Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 7-12 ©Best Best & Krieger LLP <br />7.14 GENERAL ASPECTS OF AN EIR. <br />Both a Draft and Final EIR must contain the information outlined in Local Guidelines <br />Sections 7.17 and 7.18. Each element must be covered, and when elements are not separated into <br />distinct sections, the document must state where in the document each element is covered. <br />The body of the EIR shall include summarized technical data, maps, diagrams and similar <br />relevant information. Highly technical and specialized analyses and data should be included in <br />appendices. Appendices may be prepared in separate volumes, but must be equally available to <br />the public for examination. All documents used in preparation of the EIR must be referenced. An <br />EIR shall not include “trade secrets,” locations of archaeological sites and sacred lands, or any <br />other information subject to the disclosure restrictions of the Public Records Act (Government <br />Code section 7920.000, et seq.). <br />The EIR should discuss environmental effects in proportion to their severity and <br />probability of occurrence. Effects dismissed in the Initial Study as clearly insignificant and <br />unlikely to occur need not be discussed. <br />The Initial Study should be used to focus the EIR so that the EIR identifies and discusses <br />only the specific environmental problems or aspects of the project that have been identified as <br />potentially significant or important. A copy of the Initial Study should be attached to the EIR or <br />included in the administrative record to provide a basis for limiting the impacts discussed. <br />The EIR shall contain a statement briefly indicating the reason for determining that various <br />effects of a project that could possibly be considered significant were not found to be significant <br />and consequently were not discussed in detail in the EIR. The City should also note any conclusion <br />by it that a particular impact is too speculative for evaluation. <br />The EIR should omit unnecessary descriptions of projects and emphasize feasible <br />mitigation measures and alternatives to projects. <br />7.15 USE OF REGISTERED CONSULTANTS IN PREPARING EIRS. <br />An EIR is not a technical document that can be prepared only by a registered consultant or <br />professional. However, state statutes may provide that only registered professionals can prepare <br />certain technical studies that will be used in an EIR, or that will control the detailed design, <br />construction, or operation of the proposed project and that will be prepared in support of an EIR. <br />(Reference: State CEQA Guidelines, § 15149.) <br />7.16 INCORPORATION BY REFERENCE. <br />An EIR, Negative Declaration, or Mitigated Negative Declaration may incorporate by <br />reference all or portions of another document that is a matter of public record or is generally <br />available to the public. Any incorporated document shall be considered to be set forth in full as <br />part of the text of the environmental document.
