Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 7-31 ©Best Best & Krieger LLP <br />revised and the entire EIR is recirculated, the City may require that reviewers submit new <br />comments and need not respond to those comments received during the earlier circulation period. <br />In those cases, the City should advise reviewers that, although their previous comments remain <br />part of the administrative record, the final EIR will not provide a written response to those <br />comments, and new comments on the revised EIR must be submitted. The City need only respond <br />to those comments submitted in response to the revised EIR. <br />When the EIR is revised only in part and the City is recirculating only the revised chapters <br />or portions of the EIR, the City may request that reviewers limit their comments to the revised <br />chapters or portions. The City need only respond to: (1) comments received during the initial <br />circulation period that relate to chapters or portions of the document that were not revised and <br />recirculated, and (2) comments received during the recirculation period that relate to the chapters <br />or portions of the earlier EIR that were revised and recirculated. <br />When recirculating a revised EIR, either in whole or in part, the City must, in the revised <br />EIR or by an attachment to the revised EIR, summarize the revisions made to the previously <br />circulated draft EIR. <br />(Reference: State CEQA Guidelines, § 15088.5.) <br />7.33 CERTIFICATION OF FINAL EIR. <br />Following the preparation of the Final EIR, Staff shall review the Final EIR and make a <br />recommendation to the decision-making body regarding whether the Final EIR has been completed <br />in compliance with CEQA, the State CEQA Guidelines and the City’s Local Guidelines. The Final <br />EIR and Staff recommendation shall then be presented to the decision-making body. The decision- <br />making body shall independently review and consider the information contained in the Final EIR <br />and determine whether the Final EIR reflects its independent judgment. Before it approves the <br />project, the decision-making body must certify and find that: (1) the Final EIR has been completed <br />in compliance with CEQA, the State CEQA Guidelines and the City’s Local Guidelines; (2) the <br />Final EIR was presented to the decision-making body and the decision-making body reviewed and <br />considered the information contained in the Final EIR before approving the project; and (3) the <br />Final EIR reflects the City’s independent judgment and analysis. <br />Except in those cases in which the City Council is the final decision-making body for the <br />project, any interested person may appeal the certification or denial of certification of a Final EIR <br />to the City Council. Appeals must follow the procedures prescribed by the City. <br />(Reference: State CEQA Guidelines, § 15090.) <br />7.34 CONSIDERATION OF EIR BEFORE APPROVAL OR DISAPPROVAL OF PROJECT. <br />Once the decision-making body has certified the EIR, it may then proceed to consider the <br />proposed project for purposes of approval or disapproval. <br />(Reference: State CEQA Guidelines, § 15092.)
