Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) AFFORDABLE HOUSING <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 9-28 ©Best Best & Krieger LLP <br />If the City determines that a project is exempt from CEQA as an interim motel housing <br />project, it must file a Notice of Exemption with the State Clearinghouse. <br />(Reference: Pub. Resources Code, § 21080.50 [in effect until January 1, 2025].) <br />9.06 SUPPORTIVE HOUSING AND “NO PLACE LIKE HOME” PROJECTS. <br />A decision by the City to seek funding from, or the Department of Housing and Community <br />Development’s awarding of funds pursuant to, the “No Place Like Home Program” (set forth in <br />Part 3.9 of Division 5 of the Welfare and Institutions Code, commencing with Section 5849.1) <br />does not constitute a “project” under CEQA. <br />“Supportive housing” in areas where multifamily and mixed uses are permitted may be a <br />“use by right” and thus exempt from CEQA if the supportive housing project meets certain criteria <br />set forth in Government Code section 65651. A “supportive housing” project is a project that <br />provides housing with no limit on length of stay, that is occupied by persons within the target <br />population—i.e., persons with disabilities, families who are homeless, or homeless youth—and <br />that is linked to onsite or offsite services that assist the supportive housing resident to retain <br />housing, improve their health status, and maximize their ability to live and, when possible, work <br />in the community. A policy by a city or county to approve as a use by right proposed housing <br />developments with a limit higher than 50 units does not constitute a “project” under CEQA. To <br />see the requirements of the exemptions relating to supportive housing, please see Government <br />Code section 65651. <br />If a No Place Like Home project is not exempt from CEQA under Government Code <br />section 65651, the development applicant may request, within 10 days after the City determines <br />the type of environmental documentation required for the project under CEQA, that the City <br />prepare and certify the record of proceeding for the environmental review of the No Place Like <br />Home project in accordance with Public Resources Code section 21186. <br />If the City approves or determines to carry out a No Place Like Home project that is subject <br />to CEQA, the City shall file a notice of that approval or determination in accordance with the <br />requirements of Public Resources Code section 21151, subdivision (a), except that the Notice of <br />Determination shall be filed within two working days after the approval or determination becomes <br />final. Likewise, if the City approves or determines to carry out a No Place Like Home project that <br />is not subject to CEQA, the City shall file a Notice of Exemption in accordance with the <br />requirements of Public Resources Code section 21152, subdivision (b), except that the Notice of <br />Exemption shall be filed within two working days after the approval or determination becomes <br />final. <br />(Reference: Pub.
