Resolution No. 2023-XXX <br />Page 1 of 2 <br />RESOLUTION NO. 2023-XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA ADOPTING LOCAL CEQA GUIDELINES <br />FOR IMPLEMENTING THE CALIFORNIA <br />ENVIRONMENTAL QUALITY ACT (PUBLIC <br />RESOURCES CODE SECTIONS 21000 ET SEQ.) <br />WHEREAS, the California Legislature has amended the California Environmental <br />Quality Act (“CEQA”) (Public Resources Code sections 21000 et seq.), the Natural Resources <br />Agency has amended the State CEQA Guidelines (California Code of Regulations, Title 14, <br />sections 15000 et seq.), and the California courts have interpreted specific provisions of CEQA; <br />and <br />WHEREAS, Public Resources Code section 21082 requires all public agencies to adopt <br />objectives, criteria and procedures for (1) the evaluation of public and private projects <br />undertaken or approved by such public agencies, and (2) the preparation, if required, of <br />environmental impact reports and negative declarations in connection with that evaluation; and <br />WHEREAS, the City of Santa Ana has prepared local guidelines for implementing CEQA <br />to make them consistent with the current provisions and interpretations of CEQA and the State <br />CEQA Guidelines. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as <br />follows: <br />Section 1. The City hereby adopts the “2023 Local Guidelines for Implementing the <br />California Environmental Quality Act for City of Santa Ana,” attached hereto and incorporated <br />herein as Attachment A, a copy of which is on file at the offices of the City and is available for <br />inspection by the public. <br />Section 2. It is the intent of the City to conform to the requirements of the State CEQA <br />Guidelines and CEQA. If any of the specific procedures or provisions adopted herein should <br />be in conflict with CEQA or the State CEQA Guidelines, then CEQA and the State Guidelines <br />shall prevail. The City may administer its responsibilities under CEQA in any manner which <br />meets the requirements of CEQA, notwithstanding the specific procedures set forth in the City’s <br />Local CEQA Guidelines. All future revisions to CEQA and the State CEQA Guidelines shall <br />hereafter be considered to be part of the City’s implementing procedures without further action <br />by the City Council. <br />Section 3. No environmental impact is anticipated from the adoption of the 2023 <br />Local CEQA Guidelines. The City’s adoption of the attached Resolution is not a project under <br />State CEQA Guidelines section 15378(b)(5) because it involves an administrative activity that <br />will not result in direct or indirect physical changes in the environment. <br />Section 4. This Resolution shall take effect immediately upon its adoption by the City <br />Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution. <br />EXHIBIT 1
