Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ACTIVITIES EXEMPT FROM CEQA <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 3-20 ©Best Best & Krieger LLP <br />Moreover, a project exempt under this section may be subject to certain labor <br />requirements, including that the project be completed by a skilled and trained workforce, as set <br />forth in Public Resources Code section 21080.25(f). <br /> <br />If the City determines that a project is not subject to CEQA pursuant to this section and <br />approves that project, the City must file a Notice of Exemption with both the Office of Planning <br />and Research and the County Clerk of the county in which the project is located. <br /> <br />This exemption shall remain in effect only until January 1, 2030, and as of that date it <br />will be repealed. (Reference: Pub. Resources Code, § 21080.25.) <br />3.21 TRANSPORTATION PLANS, PEDESTRIAN PLANS, AND BICYCLE TRANSPORTATION PLANS. <br />CEQA does not apply to an active transportation plan, a pedestrian plan, or a bicycle <br />transportation plan for restriping of streets and highways, bicycle parking and storage, signal <br />timing to improve street and highway intersection operations, and the related signage for bicycles, <br />pedestrians, and vehicles. An active transportation plan or pedestrian plan is encouraged to include <br />the consideration of environmental factors, but that consideration does not inhibit or preclude the <br />application of this section. <br /> <br />An individual project that is part of an active transportation plan or pedestrian plan remains <br />subject to CEQA unless another exemption applies to that project. <br /> <br />Before determining that a project is exempt pursuant to this section, the Lead Agency must <br />hold noticed public hearings in areas affected by the project to hear and respond to public <br />comments. Publication of the notice must comply with Government Code section 6061 and be in <br />a newspaper of general circulation in the area affected by the proposed project. <br /> <br />If the City determines that a project is not subject to CEQA pursuant to this section and <br />approves that project, the City must file a Notice of Exemption with both the Office of Planning <br />and Research and the County Clerk of the county in which the project is located. <br /> <br />For purposes of this section, the following definitions apply: <br /> <br />(1) “Active transportation plan” means a plan developed by a local jurisdiction that <br />promotes and encourages people to choose walking, bicycling, or rolling through the creation of <br />safe, comfortable, connected, and accessible walking, bicycling, or rolling networks, and <br />encourages alternatives to single-occupancy vehicle trips. <br /> <br />(2) “Pedestrian plan” means a plan developed by a local jurisdiction that establishes a <br />comprehensive, coordinated approach to improving pedestrian infrastructure and safety. <br /> <br />This exemption shall remain in effect only until January 1, 2030, and as of that date it will <br />be repealed.
