Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ACTIVITIES EXEMPT FROM CEQA <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 3-22 ©Best Best & Krieger LLP <br />of these Local Guidelines, below). If none of the exemptions referenced in this paragraph apply <br />to a project that is otherwise exempt under this section, the notice of exemption must explain why <br />the exemptions referenced in this paragraph do not apply to the project. <br />For purposes of this section, the following definitions apply: <br />A “well” is defined as a wellhead that provides drinking water to a “water system.” <br />A “domestic well” is defined as a groundwater well used to supply water for the domestic <br />needs of an individual residence or a water system that is not a public water system and that has <br />no more than four service connections. <br />A “water system” is defined to mean a “public water system” as that term is defined in <br />Health and Safety Code section 116275(h) (i.e., a system for the provision of water for human <br />consumption through pipes or other constructed conveyances that has 15 or more service <br />connections or regularly serves at least 25 individuals daily at least 60 days out of the year), a <br />“state small water system” as that term is defined in Health and Safety Code section 116275(n) <br />(i.e., a system for the provision of piped water to the public for human consumption that serves at <br />least five, but not more than 14, service connections and does not regularly serve drinking water <br />to more than an average of 25 individuals daily for more than 60 days out of the year), or a tribal <br />water system. <br />(Pub. Resources Code, § 21080.31 [in effect until January 1, 2028].) <br /> <br />3.23 SMALL DISADVANTAGED COMMUNITY WATER SYSTEM AND STATE SMALL WATER <br />SYSTEM. <br />CEQA does not apply to certain water infrastructure projects that primarily benefit a “small <br />disadvantaged community water system” or a “state small water system,” as these terms are <br />defined in Public Resources Code section 21080.47. If certain labor requirements and other <br />conditions are met as set forth in Public Resources Code section 21080.47, the installation, repair, <br />or construction of the following for the benefit of a small disadvantaged community water system <br />or state small water system is exempt from CEQA: <br /> <br />(1) Drinking water groundwater wells with a maximum flow rate of up to 250 gallons <br />per minute; <br /> <br />(2) Drinking water treatment facilities with a footprint of less than 2,500 square feet <br />that are not located in an environmentally sensitive area; <br /> <br />(3) Drinking water storage tanks with a capacity of up to 250,000 gallons; <br /> <br />(4) Booster pumps and hydropneumatic tanks; <br />
