Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ACTIVITIES EXEMPT FROM CEQA <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 3-26 ©Best Best & Krieger LLP <br />these classes are considered to apply in all instances except when the project may impact an <br />environmental resource of hazardous or critical concern that has been designated, precisely <br />mapped, and officially adopted pursuant to law by federal, state, or local agencies. <br />All classes of categorical exemptions are qualified. None of the categorical exemptions <br />are applicable if any of the following circumstances exist: <br />(1) The cumulative impact of successive projects of the same type in the same place <br />over time is significant; <br />(2) There is a reasonable possibility that the activity will have a significant effect on <br />the environment due to unusual circumstances; <br />(3) The project may result in damage to a scenic resource or may result in a substantial <br />adverse change to a historical resource; or <br />(4) The project is located on a site which is included on any hazardous waste site or list <br />compiled pursuant to Government Code section 65962.5. <br />However, a project’s greenhouse gas emissions do not, in and of themselves, cause an <br />exemption to be inapplicable if the project otherwise complies with all applicable regulations or <br />requirements adopted to implement statewide, regional, or local plans consistent with State CEQA <br />Guidelines section 15183.5. <br />With the foregoing limitations in mind, the following classes of activity are generally <br />exempt from CEQA: <br />Class 1: Existing Facilities. Activities involving the operation, repair, maintenance, <br />permitting, leasing, licensing, minor alteration of—or legislative activities to regulate—existing <br />public or private structures, facilities, mechanical equipment or other property, or topographical <br />features, provided the activity involves negligible or no expansion of existing or former use. The <br />types of “existing facilities” itemized in State CEQA Guidelines section 15301 are not intended to <br />be all-inclusive of the types of projects which might fall within the Class 1 categorical exemption. <br />The key consideration is whether the project involves negligible or no expansion of use. (State <br />CEQA Guidelines, § 15301.) <br />Class 2: Replacement or Reconstruction. Replacement or reconstruction of existing <br />facilities, structures, or other property where the new facility or structure will be located on the <br />same site as the replaced or reconstructed facility or structure and will have substantially the same <br />purpose and capacity as the replaced or reconstructed facility or structure. (State CEQA <br />Guidelines, § 15302.) <br />Class 3: New Construction or Conversion of Small Structures. Construction of limited <br />numbers of small new facilities or structures; installation of small new equipment or facilities in <br />small structures; and the conversion of existing small structures from one use to another, when <br />only minor modifications are made in the exterior of the structure. This exemption includes <br />structures built for both residential and commercial uses. (State CEQA Guidelines, § 15303 <br />outlines, among other things, the maximum number of structures allowable under this exemption.)
