Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) NEGATIVE DECLARATION <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 6-10 ©Best Best & Krieger LLP <br />(Reference: Pub. Resources Code, § 21092; State CEQA Guidelines, §§ 15072-15073.) <br />6.11 SUBMISSION OF NEGATIVE DECLARATION OR MITIGATED NEGATIVE DECLARATION TO <br />STATE CLEARINGHOUSE. <br />A Negative Declaration or Mitigated Negative Declaration must be submitted to the State <br />Clearinghouse, in an electronic form as required by the Office of Planning and Research, regardless <br />of whether the document must be circulated for review and comment by state agencies under State <br />CEQA Guidelines section 15205 and 15206. The Negative Declaration or Mitigated Negative <br />Declaration must be submitted via the Office of Planning and Research’s CEQA Submit website <br />(https://ceqasubmit.opr.ca.gov/Security/LogOn?ReturnUrl=%2f). The CEQA Submit website <br />differentiates between environmental documents that do require review and comment by state <br />agencies and those that do not. In particular, the website provides a “Local Review Period” tab <br />for submitting documents that do not require review and comment by state agencies, and a “State <br />Review Period” tab for submitting documents that do require review and comment by state <br />agencies. <br />A Negative Declaration or Mitigated Negative Declaration must be submitted to the State <br />Clearinghouse for review and comment by state agencies (i.e., a Negative Declaration or Mitigated <br />Negative Declaration must be submitted through the CEQA Submit website under the “State <br />Review Period” tab) in the following situations: <br />(a) The Negative Declaration or Mitigated Negative Declaration is prepared by a Lead Agency <br />that is a state agency; <br />(b) The Negative Declaration or Mitigated Negative Declaration is prepared by a public <br />agency where a state agency is a Responsible Agency, Trustee Agency, or otherwise has <br />jurisdiction by law with respect to the project; or <br />(c) The Negative Declaration or Mitigated Negative Declaration is for a project identified in <br />State CEQA Guidelines section 15206 as being of statewide, regional, or area-wide <br />significance. <br />State CEQA Guidelines section 15206 identifies the following types of projects as being <br />examples of projects of statewide, regional, or area-wide significance that require submission to <br />the State Clearinghouse for circulation: <br />(1) Projects that have the potential to cause significant environmental effects beyond <br />the city or county where the project would be located, such as: <br />(a) Residential development of more than 500 units; <br />(b) Commercial projects employing more than 1,000 persons or covering more <br />than 500,000 square feet of floor space; <br />(c) Office building projects employing more than 1,000 persons or covering <br />more than 250,000 square feet of floor space; <br />(d) Hotel or motel development of more than 500 rooms; or <br />(e) Industrial projects housing more than 1,000 persons, occupying more than <br />40 acres of land, or covering more than 650,000 square feet of floor area;
