Local Guidelines for hnple renting the <br />California Enviromnental Ouaih, Act (2023) AFFORDABLE HOUSING <br />"affordable rent" has the same meaning as set forth in Section <br />50063 of the Health and Safety Code. <br />(13) For a development for which an application pursuant to this <br />section was submitted prior to January 1, 2019, that includes 500 <br />units or more of housing, and that dedicates 50 percent of the total <br />number of units to housing affordable to households making at, or <br />below, 80 percent of the area median income, affordable rent for at <br />least 30 percent of these units shall be set at an affordable rent as <br />defined in subparagraph (k)(1), and "affordable rent" for the <br />remainder of these units shall mean a rent that is consistent with the <br />maximum rent levels for a housing development that receives an <br />allocation of state or federal low-income housing tax credits from <br />the California Tax Credit Allocation Committee. <br />(3) "Department" means the Department of Housing and Community <br />Development. <br />(4) "Development proponent" means the developer who submits an application <br />for streamlined approval pursuant to this section. <br />(5) "Completed entitlements" means a housing development that has received <br />all the required land use approvals or entitlements necessary for the issuance <br />of a building permit. <br />(6) "Locality" or "local government" means a city, including a charter city, a <br />county, including a charter county, or a city and county, including a charter <br />city and county. <br />(7) "Moderate income housing units" means housing units with an affordable <br />housing cost or affordable rent for persons and families of moderate income, <br />as that term is defined in Section 50093 of the Health and Safety Code. <br />(8) "Production report" means the information reported pursuant to <br />'subparagraph (D) of paragraph (2) of subdivision (a) of Government Code <br />section 65400. <br />(9) "State agency" includes every state office, officer, department, division, <br />bureau, board, and commission, but does not include the California State <br />University or the University of California. <br />(10) "Subsidized" means units that are price or rent restricted such that the units <br />are affordable to households meeting the definitions of very low and lower <br />income, as defined in Sections 50079.5 and 50105 of the Health and Safety <br />Code. <br />2023 City of Santa Ana Local Guidelines 9-21 ©Best Best & Krieger LLP <br />
