EXHIBIT "C <br />RECORDING REQUESTED BY, <br />AND WHEN RECORDED MAIL TO: <br />City of Santa Ana <br />20 Civic Center Plaza, 6th Floor <br />Santa Ana, California 92702 <br />Attn: Executive Director <br />This document is exempt from <br />payment of a recording fee <br />pursuant to Government Code <br />Sections 27383 and 6103. <br />NOTICE OF AFFORDABILITY RESTRICTIONS ON <br />TRANSFER OF PROPERTY <br />This Notice of Affordability Restrictions on Transfer of Property (or "Notice <br />of Affordability Restrictions") is executed and recorded pursuant to Section 65915 <br />of the California Government Code, and affects that certain real property generally <br />located at in the City of Santa Ana, California, as legally <br />described in Exhibit A hereto ("Property"). The City of Santa Ana, a charter city <br />and municipal corporation of the State of California (referred to herein as "City"), <br />and Warmington Residential California, Inc. ("Developer/Property Owner") have <br />entered into that certain Density Bonus Housing Agreement dated as of December <br />6th, 2022 ("Density Bonus Housing Agreement"). <br />1. The Density Bonus Housing Agreement provides for affordability <br />restrictions and restrictions on the Property, as more particularly set forth in the <br />Density Bonus Housing Agreement. A copy of the Density Bonus Housing <br />Agreement is on file with City as a public record and is deemed incorporated herein. <br />Reference is made to the Density Bonus Housing Agreement with regard to the <br />complete text of the provisions of such agreement and all defined terms therein, <br />which provides for affordability restrictions and restrictions on the transfer of the <br />Property. <br />2. For a period commencing upon the date on which a deed conveying the <br />Affordable Unit to a member of the homebuying public is recorded and terminating <br />on the fifty-fifth (55th) anniversary thereof, the Property may only be transferred to <br />1 <br />
