2.In cases where areas of authority overlap, it is the responsibility of the EEO Officer to <br />advise the complainant of the existence of State, Federal and other proper action <br />agencies, which may also have a bearing. <br />3.Complainants alleging discrim ination under this part will be made aware of their right to <br />file directly with the Office of Civil Rights (OCR), U.S. Department of Labor and <br />applicable procedures. <br />4.Complainants must file their complaint directly with: <br />Daniel Durham <br />Sr. Personnel Analyst -EEO Officer <br />20 Civic Center Drive, M-24 <br />Santa Ana, CA 92701 <br />(714)647-5330 <br />VI.Procedures for Handling Disability Complaints by Participants <br />Complaints alleging discrimination on the basis of disability will be filed and processed under <br />the Department of Labor regulations implementing Section 504 of the Rehabilitation Act of 1973 <br />at 29 Code of Federal Regula tions Section 32. <br />1.Complaints must exhaust the Santa Ana LWDA's informal resolution procedures <br />before filing their complaint with OCR. <br />2.Complainants will be made aware of the 180 days requirement in which to file his/her <br />complaint. <br />A.Procedures at the LWDA Level <br />1.The complainant shall file his/her complaint directly with the Santa Ana LWDA. Upon <br />receipt of the complaint, the EEO Officer shall investigate and gather information <br />concerning the complai nt. <br />2.An informal conference will be held with the parties conc erned in an effort to resolve the <br />issue(s). The complainant has the right to be present and may be represented during <br />the conference. <br />3.The Santa Ana LWDA shall issue in writing its decision to the complainant no later than <br />thirty (30) days after the filing of the complaint. <br />B.Procedures at the State Level <br />1.The complainant may appeal to the State if he/she is not satisfied with the decision of the <br />Santa Ana LWDA. <br />17 <br />EXHIBITC <br />EXHIBIT 1
