<br />Page | 32 <br />4894-6811-3695v.2 0017787-000542 <br />4894-6811-3695v.2 0017787-000542 <br />Coverages Minimum Limits <br />Commercial General Liability <br />Including Sexual Misconduct (defined as abuse, <br />molestation and assault and battery) <br />$5,000,000 per occurrence <br />$5,000,000 aggregate <br />Automobile Liability including coverage for owned, <br />non-owned and hired vehicles <br />$1,000,000 limit per occurrence <br />Workers' Compensation Statutory Minimum <br />Employers' Liability Insurance $1,000,000 per occurrence <br />Commercial Property Insurance on an "All Risk" or <br />"Special Causes of Loss" basis covering all <br />buildings, contents and any tenant improvements <br />including Business Interruption/Loss of Rents with <br />a 12 month limit <br />100% of the Replacement Cost Value <br />and no coinsurance provision <br /> <br />Tenant shall provide a builder’s risk policy, naming the Contractor, providing coverage for the full <br />project value and no coinsurance provision. The policy shall provide coverage for all perils excluding <br />earthquake, and flood. Tenant is responsible for any deductible amount. The County of Orange and <br />the Housing Authority of the City of Santa Ana shall be named as Loss Payees as its financial <br />interests may appear. This shall be evidenced by a Loss Payee endorsement which shall accompany <br />the Certificate of Insurance. <br /> <br />The Builder's Risk policy shall not be required to cover any tools, equipment, or supplies, unless <br />such tools, equipment, or supplies are part of the Work being constructed. The Contractor shall be <br />responsible for securing and maintaining appropriate insurance on any tools, equipment, or supplies <br />that are not part of the work being constructed. <br /> <br />The County and the Contractor waive all rights against each other and the subcontractors, sub - <br />subcontractors, officers, and employees of each other, and the Contractor waives all rights against <br />County’s separate contractors, if any, and their subcontractors, sub -subcontractors, officers and <br />employees for damages caused by fire or other perils to the extent paid by the Builder’s Risk <br />insurance, except such rights as they may have to the proceeds of such insurance. The Contractor <br />shall require of its subcontractors and sub-subcontractors by appropriate agreements, similar waivers, <br />each in favor of all other parties enumerated in the preceding sentence. <br /> <br />(g) The policy or policies of insurance maintained by the TENANT’S <br />CONTRACTOR AFTER CONSTRUCTION shall provide the minimum limits and coverage as <br />set forth below when performing maintenance and minor work after the building is in operation: <br />Coverages Minimum Limits <br />EXHIBIT 11
