<br />19 <br /> <br />Developer’s obligations under these Restrictions; or (b) to claim that the existence of any <br />such obligation, liability or claim excuses the nonperformance by Developer of any of its <br />obligations under these Restrictions. <br />24. CSCDA Regulatory Agreement. The parties hereto acknowledge that the <br />Developer and California Statewide Communities Development Authority are entering <br />into that certain Regulatory Agreement and Declaration of Restrictive Covenant s (the <br />“CSCDA Regulatory Agreement”) with respect to the Property and the issuance of tax- <br />exempt financing and further agree that as long as the CSCDA Regulatory Agreement is <br />in effect, to the extent of any conflicting provisions between the CSCDA Regulatory <br />Agreement and the Restrictions, the CSCDA Regulatory Agreement shall control. That <br />notwithstanding, the fact that the Restrictions and the CSCDA Regulatory Agreement <br />provide for greater, lesser or different obligations or requirements shall not be deem ed a <br />conflict unless the applicable provisions are inconsistent and could not be simultaneously <br />enforced or performed. <br /> <br />25. Notices.
