WDM0522 Page 21 of 45 March 1, 2022 <br /> <br />in COUNTY. The use of such items of Capital Equipment is limited to the <br />performance of this Agreement. Upon the termination of this Agreement, <br />CONTRACTOR shall immediately return any items of Capital Equipment to <br />COUNTY or its representatives, or dispose of them in accordance with the <br />directions of ADMINISTRATOR. <br />CONTRACTOR further agrees to the following: <br />18.1.1 To maintain all items of Capital Equipment in good working order and <br />condition, normal wear and tear excepted. <br />18.1.2 To label all items of Capital Equipment, do periodic inventories as <br />required by ADMINISTRATOR, and to maintain an inventory list <br />showing where and how the Capital Equipment is being used, in <br />accordance with procedures developed by ADMINISTRATOR. All such <br />lists shall be submitted to ADMINISTRATOR within ten (10) days of any <br />request. <br />18.1.3 To report in writing to ADMINISTRATOR immediately after discovery, <br />the loss or theft of any items of Capital Equipment. For stolen items, the <br />local law enforcement agency must be contacted and a copy of the police <br />report submitted to ADMINISTRATOR. <br />18.1.4 To purchase a policy or policies of insurance covering loss or damage to <br />any and all Capital Equipment purchased under this Agreement, in the <br />amount of the full replacement value thereof, providing protection against <br />the classification of fire, extended coverage, vandalism, malicious <br />mischief, and special extended perils (all risks) covering the parties’ <br />interests as they appear. <br />18.2 The purchase of any Capital Equipment by CONTRACTOR shall be requested in <br />writing, shall require the prior written approval of ADMINISTRATOR, and shall <br />fulfill the provisions of this Agreement which are appropriate and directly related <br />to CONTRACTOR’s service or activity under the terms of this Agreement. <br />COUNTY may refuse reimbursement for any costs resulting from Capital <br />Equipment purchased which are incurred by CONTRACTOR, if prior written
