<br />NOTICE OF PUBLIC HEARING
<br />BEFORE THE CITY COUNCIL OF THE
<br />CITY OF SANTA ANA,CA.
<br />The City of Santa Ana encourages the
<br />public to participate in the decision-
<br />making process.The following notice
<br />is being provided so that you can ask
<br />questions,make comments and stay
<br />informed about projects that might be
<br />important to you.We encourage you to
<br />contact us prior to the Public Hearing if
<br />you have any questions.
<br />NOTICE IS HEREBY GIVEN -The City
<br />Council of the City of Santa Ana will hold
<br />a public hearing to receive public
<br />testimony and will take action on the item
<br />described below.
<br />Proposed Action:The City Council is
<br />considering the adoption of Zoning
<br />Ordinance Amendment No.2021-03 to
<br />amend the Santa Ana Municipal Code
<br />repealing and reenacting in its entirety
<br />Article XVIII.I.of Chapter 41 of the Santa
<br />Ana Municipal Code regarding the
<br />Housing Opportunity Ordinance.The
<br />proposed Amendment will modernize and
<br />update the Ordinance to clarify the
<br />purpose and applicability of the proposed
<br />regulations,to clarify vesting provisions
<br />for development projects,to modify the in-
<br />lieu fee structure,and to incentivize the
<br />use of a skilled and trained local
<br />workforce,as well as other various
<br />sections of the Ordinance to respond to
<br />current development and economic
<br />trends.The Planning Commission vote on
<br />October 25,2021,resulted in a 4-3
<br />(Calderon,McLoughlin and Morrissey
<br />dissented)recommendation that the City
<br />Council adopt the proposed Amendment
<br />with certain modifications.
<br />Environmental Impact:There is no
<br />environmental impact associated with this
<br />action in that the Ordinance is not subject
<br />to the California Environmental Quality
<br />Act (CEQA)pursuant to Sections
<br />15060(c)(2)and 15060(c)(3)of the State
<br />CEQA Guidelines because it will not result
<br />in a direct or reasonably foreseeable
<br />indirect physical change in the
<br />environment,as there is no possibility it
<br />will have a significant effect on the
<br />environment and it is not a "project",as
<br />defined in Section 15378 of the CEQA
<br />Guidelines.Furthermore,the proposed
<br />Ordinance falls within the "common
<br />sense"CEQA exemption set forth in
<br />CEQA Guidelines Section 15061(b)(3),
<br />excluding projects where "it can be seen
<br />with certainty that there is no possibility
<br />that the activity in question may have a
<br />significant effect on the environment."
<br />Adoption of this Ordinance will not have a
<br />significant effect on the environment
<br />because the proposed changes will only
<br />modernize,update,and clarify existing
<br />affordable and inclusionary housing
<br />requirements responding to the current
<br />economic and housing trends in the City
<br />and will not cause a physical change in
<br />the environment.Notice of Exemption,
<br />Environmental Review No.2021-107 will
<br />be filed for this project.
<br />Meeting Time and Date –This matter will
<br />be heard on Tuesday,November 16,
<br />2021 at 5:45 p.m.or thereafter in the City
<br />Council Chamber,22 Civic Center Plaza,
<br />Santa Ana,California 92702.All persons
<br />interested in this matter are notified to
<br />appear at this time.

<br />wish to appear at the public hearing,you
<br />may also send your written comments to
<br />the Clerk of the Council,by mail to City of
<br />Santa Ana,20 Civic Center Plaza –M30,
