SUBSTANTIAL AMENDMENT TO THE <br />FISCAL YEAR 2021-2022 ANNUAL ACTION PLAN <br />Substantial Amendment # 1 <br />3 SUBSTANTIAL AMENDMENT TO THE <br />FISCAL YEAR 2021-2022 ANNUAL ACTION PLAN <br />11/2021 <br /> <br /> <br /> <br />Title 24 Section 91.505 of the Code of Federal Regulations stipulates that participating <br />jurisdictions shall amend their approved plans whenever they make one of the following <br />decisions: <br /> <br />1. To make a change in its allocation priorities or a change in the method of distribution of <br />funds; <br />2. To carry out an activity, using funds from any program covered by the Consolidated Plan <br />(including program income) not previously described in the action plan; or <br />3. To change the purpose, scope, location, or beneficiaries of an activity. <br /> <br />In addition, U.S. Department of Housing and Urban Development, Community Planning and <br />Development Notice CPD-21-10, instructs Participating Jurisdictions (PJ), that in order to <br />receive its HOME-ARP funds, a PJ must engage in consultation, facilitate the public <br />participation processes, develop a HOME-ARP allocation plan, Exhibit 2, that meets the <br />requirements established in section V. of the Notice, and to submit it to HUD as a substantial <br />amendment to its Fiscal Year 2021 annual action plan. <br /> <br />CPD-21-10 stipulates that HUD will be using the waiver and alternative requirement authority <br />provided by ARP to establish requirements for the HOME-ARP allocation plan. The HOME-ARP <br />allocation plan must describe how the PJ intends to distribute HOME-ARP funds, including how <br />it will use these funds to address the needs of HOME-ARP qualifying populations. A PJ’s HOME- <br />ARP allocation plan must include: <br /> A summary of the consultation process and results of upfront consultation; <br /> A summary of comments received through the public participation process and <br />a summary of any comments or recommendations not accepted and the <br />reasons why; <br /> A description of HOME-ARP qualifying populations within the jurisdiction; <br /> An assessment of unmet needs of each qualifying population; <br /> An assessment of gaps in housing and shelter inventory, homeless assistance <br />and services, and homelessness prevention service delivery system; <br /> A summary of the planned use of HOME-ARP funds for eligible activities based on <br />the unmet needs of the qualifying populations; <br /> An estimate of the number of housing units for qualifying populations the PJ <br />will produce or preserve with its HOME-ARP allocation; and <br /> A description of any preferences for individuals and families in a particular <br />qualifying population or a segment of a qualifying population. <br /> <br />All the above required elements of the HOME-ARP allocation plan shall be part of the FY <br />2021 annual action plan for purposes of the HOME-ARP program. Consequently, PJs are not <br />required to amend their consolidated plans. <br />EXHIBIT 2
