Housing Opportunity Ordinance <br />September 7, 2021 <br />Page 4 <br />2 <br />0 <br />5 <br />1 <br />41-1904 In-Lieu Fee Option: <br />Revises the in-lieu fee <br />and changes the timing <br />of payment <br />This section is amended to increase the <br />in-lieu fee from $5 per habitable square <br />foot to $15 per habitable square foot. <br />This section also removes the incentive <br />for “Entitled Residential Projects” to <br />obtain building permits during the current <br />economic climate. The provision for <br />“Entitled Residential Projects” no longer <br />applies after October 1, 2021. <br />The amendments also extend the timing <br />of payment from issuance of the building <br />permit to issuance of the certificate of <br />occupancy, allowing a developer the <br />option to pay after the project is <br />developed in order to make the larger <br />fee more reasonable. <br />41-1904 (c)(ii) <br />41-1909(a)(5) <br />Skilled and Trained <br />Workforce and <br />Sliding In-Lieu Fee <br />Schedule: <br />Incorporates a skilled <br />and trained workforce <br />requirement and a <br />local hire requirement <br />This section is amended to incorporate a <br />skilled and trained workforce <br />requirement and a sliding scale for the <br />payment of an in-lieu fee pending City <br />Council direction. <br />The amendment also incorporates a <br />local hire requirement where a developer <br />of 20 or more housing units must ensure <br />a minimum 30% local hire. <br />41-1906 Standards: <br />Revised the term of <br />affordability for <br />ownership and rental <br />units on-site <br />This section is amended to require units <br />for sale and rental units that are built on- <br />site to be affordable in perpetuity as an <br />enhancement.
