County of Orange <br />OC Community Resources <br />Page 38 of 42 City of Santa Ana <br />Contract No.:MA-012-22010003 <br /> <br />any Pell Grants, Higher Education Act Title IV awards and other financial aid granted to each <br />WIOA participant under this Contract. <br /> <br />60. Policies and Procedures: Contractor shall monitor its program for compliance with the <br />provisions of this Contract. Contractor shall also comply with all applicable parts of County’s <br />WIOA Policies and Procedures for recruitment, intake, assessment and referral, copies of which <br />are available from County’s Project Manager. <br /> <br />61. Sweat-free Code of Conduct: All Contractors contracting for the procurement or laundering of <br />apparel, garments or corresponding accessories, or the procurement of equipment, materials, or <br />supplies, other than procurement related to a public works contract, declare under penalty of <br />perjury that no apparel, garments or corresponding accessories, equipment, or supplies have been <br />furnished to the Contractor from sources that include sweatshop labor, forced labor, convict labor, <br />indentured labor under penal sanction, abusive forms of child labor or exploitation of children in <br />sweatshop labor. The Contractor further declares under penalty of perjury that they adhere to the <br />Sweat-free Code of Conduct as set forth on the California Department of Industrial Relations <br />website located at www.dir.ca.gov, and Public Contract Code Section 6108. <br /> <br />The Contractor agrees to cooperate fully in providing reasonable access to the Contractor’s <br />records, documents, agents or employees, or premises if reasonably required by authorized <br />officials of the State or County, the Department of Industrial Relations, or the Department of <br />Justice to determine the Contractor’s compliance with the requirements under this paragraph. <br /> <br />62. S.W.A.G: The Contractor and its Subcontractor/Vendors shall comply with Governor’s <br />Executive Order 2-18-2011, which bans expenditures on promotional and marketing items <br />colloquially known as “S.W.A.G.” or “Stuff We All Get.” <br /> <br />63. Corporate Status: All corporate Contractors shall be registered with the California Secretary of <br />State and shall be in good standing, without suspension by the California Secretary of State, <br />Franchise Tax Board, or Internal Revenue service. The corporate Contractor shall maintain the <br />good status standing with the Secretary of State of California throughout the term of this Contract. <br />Any change in corporate status or suspension shall be reported by Contractor immediately in <br />writing to County’s Project Manager. If Contractor fails to maintain good standing or has failed to <br />be in good standing at the time of the effective date of this Contract, County, in addition to all <br />remedies available under the law and this Contract, pursuant to Termination provision of this <br />Contract, terminate this Contract for cause. <br /> <br />Contractor, by signing this Contract, does swear under penalty of perjury that no more than one <br />(1) final unappealable finding of contempt of court by a federal court has been issued against <br />Contractor within the immediately preceding two-year period because of Contractor’s failure to <br />comply with an order of a federal court which orders the Contractor to comply with an order of <br />the National Labor Relations Board. <br /> <br />64. Equipment: All computer-related and electronic equipment purchased with funds provided under <br />this Contract or which are furnished to Contractor by County shall be considered “Equipment.” <br />This includes, but is not limited to laptops, desktop computers, iPads, cell phones, PDAs, cameras, <br />and DVD players. Title to all items of Equipment purchased vests and will remain in County, and <br />as such shall be designated by County’s Project Manager. The use of such items of Equipment is <br />limited to the performance of this Contract. Upon the termination of this Contract,
