INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CITY CLERK <br />N-2023-222 <br />DATE: <br />U NR O) LICENSE AND RIGHT OF ENTRY <br />�� C nos YWno)f� [1530 West 1Ph Street, Santa Ana, California] <br />J The Rancho Santiago Community College District as the legal owner ("Owner") of the property located <br />at 1530 West 17"' Street (Assessor Parcel Number 004-070-53, ), in the City of Santa Ana, County of <br />ua Orange (the "Property"), do hereby grant to the City of Santa Ana, a charter city and municipal <br />o corporation duly organized and existing under the Constitution and laws of the State of California, and <br />its officers, agents, employees or representatives (collectively referred to as the "City"), the right to <br />�> enter the Property and a License for the following purpose: <br />Construction relating to the Fremont Elementary and Spurgeon Intermediate SRTS <br />project Fiscal Year 22/23, which includes at this location the construction of sidewalk, <br />and curb & gutter per attached EXHIBIT A. <br />The City agrees to Indemnify, defend, and hold harmless Owner from and against any and all actions, <br />suits, claims, demands, judgments, lasses, expenses, or liabilities, Injuries and damages to persons <br />and property, Including death, arising out of or related to City's use of the Property or the entry by any <br />City party on the Property, including without limitation, City's guests, invitees, or contractors. The City <br />further agrees to repair any damage to the Property caused by the exercise of this License and Right of <br />Entry at its sole cost and expense, and to restore the Property, with the exception of any improvements <br />left thereon, as nearly as practicable to the state in which it existed prior to the use of the Property by <br />the City. <br />Insurance. <br />(1) General Liability and Property Damage. City agrees to maintain in full force and effect <br />throughout the duration of this License and Right of Entry a suitable policy or policies of comprehensive <br />general liability and property damage insurance, Insuring against all bodily injury, property damage, <br />personal injury, and other loss or liability caused by or connected with City's use of the Property under <br />this License and Right of Entry. Such insurance shall be in amounts not less than $1,000,000 per <br />occurrence; $1,000,000 for property damage and $2,000,000 for general aggregate. <br />(2) Automobile Liability. City also agrees to maintain in full force and effect with regard <br />to any vehicles which City brings onto the Property a suitable policy or policies of automobile liability <br />insurance with a combined single limit of $1,000,000 per accident. <br />(3) Workers' Compensation. City shall also maintain, in full force and effect throughout <br />the term of this License and Right of Entry Workers' Compensation insurance in accordance with the <br />laws of California, and employers' liability insurance with a limit of not less than $1,000,000 per <br />employee and $1,000,000 per occurrence. <br />(4) Notice; Additional Named Insureds. All insurance required under this License and <br />Right of Entry shall be issued by a company or companies lawfully authorized to do business In <br />Califomla as admitted carriers. District and its officers, agents, and employees shall be designated as <br />an additional named insured In the General liability and Automobile Liability policies. Prior to entry, City <br />shall provide District with Certificates of Insurance. <br />The rights herein granted to the City are exclusive, and the City agrees not to assign, transfer, lease, <br />pledge, or otherwise dispose of its License and Right of Entry without the prior express written approval <br />of the Owner. No right of entry to existing buildings on the Property is conveyed by this Instrument. <br />
