As such, any increase in the need for library resources would be implemented by the City <br />irrespective of the project, although aided by the additional tax base from development within the <br />Overlay Zone, and impacts were determined to be less than significant. <br />Mitigation Measures <br />MM-OZ 4.11-1 Individual project developers shall pay school impact fees prior to the issuance <br />of occupancy permits. <br />4.15.2 Does the Project propose changes that would result in new significant impacts or <br />substantial increase in the severity of significant impacts that will require major revisions <br />of the Certified EIR? <br />The Project includes the demolition and removal of all existing improvements from the Project <br />Site and development of the site with a mixed -use development including up to 507 residential <br />dwelling units, approximately 26,800 square feet of commercial uses, and associated parking, <br />utility infrastructure, landscaping, and open space, all of which is allowed under the Overlay Zone, <br />and is consistent with the Overlay Zone standards. The Project does not include any development <br />that would extend beyond the building envelope considered in the Certified EIR, and no changes <br />are proposed to the Overlay Zone to accommodate the Project. The Project's demand for fire <br />protection, police protection, school, library and park services would be substantially similar to <br />that identified in the Certified EIR. Additionally, the Project would be required to meet all access, <br />water and fire protection system required under the California Building Code and Fire Code and <br />the City Municipal Code. Additionally, the Project would be required to comply with the City's <br />Building Security Ordinance and the basic CPTED principles. Also, the Project would be required <br />to prepare a mandated security plan, which would require a final Police Department approval. The <br />Project would also implement Mitigation Measure MM-OZ 4.11-1 and pay school impact fees to <br />minimize impacts to school services. Finally, the Project would pay taxes that would go into the <br />City's General Fund a portion of which supports library services and would be required to make <br />payments of Park Acquisition and Development Fees based on the City's Municipal Code <br />Section 34-200 to Section 34-214 and to provide open space in accordance with the City's open <br />space requirements. Thus, the Project would not result in any new or increased significant impacts <br />related to public services beyond impacts already identified in the Certified EIR. <br />Mitigation Measures <br />The Project would implement Mitigation Measure MM-OZ 4.11-1 from the Certified EIR. <br />4.15.3 Any substantial changes in circumstances involving new significant impacts or <br />substantial increase in the severity of significant impacts that will require major revisions <br />of the Certified EIR? <br />No substantial changes in the circumstances related to public services and recreation have <br />occurred within the vicinity of the Project since the certification of the Certified EIR that would <br />result in new or more severe significant environmental impacts. <br />Cabrillo Town Center City of Santa Ana <br />Technical Memorandum August 2023 <br />City Council 18 — 613 10/3/2023 <br />
