GENERAL TERMS AND CONDITIONS <br />supply items requested herein as needed by the City at rates/prices listed in Bid submitted <br />to the City, regardless of quantity requested. <br />W. ADDITIONAL TERMS AND CONDITIONS <br />CAL -OSHA VEHICLE REGULATION: All vehicles must meet California Motor <br />Vehicle and Cal -OSHA regulations and all other applicable codes required for <br />vehicle use on the roads or highways in the state of California. <br />QUALITY ASSURANCE: Contractor shall provide laborers and supervisors who <br />are thoroughly familiar with the type of construction involved and materials and <br />techniques specified. <br />CONSTRUCTION WASTE MANAGEMENT: Contractor shall keep work areas <br />clean and free from any debris, rubbish, hazardous waste and non -usable material <br />resulting from the work under this Contract and shall be disposed of at the <br />completion of each work day by the Contractor. Hazardous waste must be <br />disposed of in accordance with the Resource Conservation and Recovery Act and <br />all other applicable federal, state, and local laws and regulations. <br />4. CHEMICALS: Handling and delivery of all materials must comply with all local, State, <br />and Federal safety regulations and must maintain appropriate hazardous material <br />transportation and handling certifications and licensing as applicable. <br />5. NON -PAYMENTS: City shall NOT make payments for any unsatisfactory work until <br />corrected. In the event of nonpayment of undisputed sums by the City, Contractor <br />shall give the City thirty (30) working days to cure the alleged breach. <br />6. DIR REGISTRATION: This project is a public work and subject to the following: No <br />contractor or subcontractor may be listed on a bid proposal for a public works project <br />(submitted on or after March 1, 2015) unless registered with the Department of <br />Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions <br />from this requirement for bid purposes only under Labor Code section 1771.1(a)]. No <br />contractor or subcontractor may be awarded a contract for public work on a public <br />works project (awarded on or after April 1, 2015) unless registered with the <br />Department of Industrial <br />Relations pursuant to Labor Code section 1725.5. This project is subject to <br />compliance monitoring and enforcement by the Department of Industrial Relations. <br />Contractors are further cautioned that certified payrolls shall be submitted <br />electronically directly to the Department of Industrial Relations. <br />7. PREVALING WAGE: - The Director of the Department of Industrial Relations of the <br />State of California hasascertained the prevailing rate of per diem wages in dollars, <br />based on a working day of eight hours, for each craft or type of worker or mechanic <br />needed to execute any construction or <br />maintenance contract, which may be awarded by Public Works.
