Public Works Agency <br />www.santa-ana.org/public-works <br />Item # 21 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />November 21, 2023 <br />TOPIC: Waste Discharge Compliance Services <br />AGENDA TITLE <br />Amend Agreement with EEC Environmental for Waste Discharge Requirement <br />Compliance Services by an Additional $250,000 for the Remainder of the Agreement <br />Term (Non -General Fund) <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute a first amendment to the agreement with EEC <br />Environmental for Waste Discharge Requirement compliance services to increase the <br />total amount by $250,000 for the remainder of the term, subject to non -substantive <br />changes approved by the City Manager and City Attorney (Agreement No. 2023-XXX). <br />GOVERNMENT CODE §84308 APPLIES: Yes <br />DISCUSSION <br />On January 19, 2021, at the conclusion of a competitive bidding process, the City <br />Council awarded a three-year agreement, with the provision for one two-year extension <br />option, to EEC Environmental (Exhibit 1) to provide waste discharge requirement <br />compliance and general environmental compliance services for the Public Works <br />Agency's Water Resources Division (Water Resources). <br />Water Resources is committed to providing a high -quality sewer collection and <br />conveyance system that is in compliance with the waste discharge requirements (WDR) <br />adopted by the State Water Resources Control Board. To maintain this level of service <br />delivery, consultant services are needed to assist staff with key WDR mandated <br />programs including Sewer System Management Plan (SSMP) auditing, maintenance <br />optimization, sewer system investigations, Fats, Oils and Grease (FOG) control <br />program implementation, along with providing expertise and support in a wide range of <br />compliance programs such as potable water monitoring and National Pollutant <br />Discharge Elimination Systems (NPDES) requirements. <br />During the agreement term, the State adopted new Statewide General Waste Discharge <br />Requirements for Sanitary Sewer Systems, Water Quality Order No. 2022-0103-DWQ <br />(Sanitary Sewer Systems General Order) in December 2022. The order requires public <br />agencies that own or operate sanitary sewer systems to develop and implement sewer <br />
