PD U) AGREEMENT WITH NATIONAL TESTING NETWORK (_,-• "J:tk0,1A)A1V FOR INVESTIGATIVE SERVICES THIS AGREEMENT is made and entered into on this I' day of February, 2024 by and between Ergometrics and Applied Personnel Research, hic, a Washington corporation doing business as National Testing Network, ('Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California Clcitylf). RECITALS A. The City desires to retain a consultant having special skill and knowledge in the field of background investigation services for the purpose of vetting Correctional Officer and Correctional Service officer applicants, volunteers, interns, and contractor employees. B. Consultant represents that it is able and willing to provide such services to the City. C. In undertaking the performance of this Agreement, Consultant represents that it is knowledgeable in its field and that any services performed by Consultant under this Agreement will be performed in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: 1. SCOPE OF SERVICES National Testing Network provides Background Investigation Services using qualified subcontracted background investigators. A Background Investigation Report (BIW') containing comprehensive candidate data, criminal history data, personal history data, candidate/reference interviews, neighborhood visit interviews, and other pertinent candidate investigation activities is prepared by a qualified subcontracted background investigator and provided to the agency by National Testing Network. 2. COMPENSATION a. City agrees to pay, and Consultant agrees to accept as total payment for its services the following sums for completed background investigations, as set forth in Exhibit A: a. $1,500 for completed Corrections investigations. b. $1,000 for completed volunteer, intern, and contractor employee investigations. c. Investigations terminated before completion at the direction of the City shall be charged on a sliding scale. The total amount to be expended during the term of this Agreement shall not exceed $20,000.
