<br />Approve Agreement for the Sale of City-Owned Real Property <br />April 2, 2024 <br />Page 2 <br />Staff notified the California Department of Housing and Community Development (HCD) <br /> for review of the City of Santa Ana’s Resolution No 2023-065 declaring properties as <br />Exempt Surplus Land. According to the resolution, the properties are less than 5,000 <br />square feet in size and are not contiguous to land owned by the state or local agency <br />that is being used for open-space or low-and moderate-income housing purposes. The <br />HCD found the subject properties qualified as exempt surplus land under Government <br />Code section 54221, subdivision (f)(1)(B), thus allowing for the transfer of ownership <br />accordingly. <br />Staff recommends approval of the recommended actions to transfer ownership of <br />unused and undevelopable land to the adjacent property owner (Exhibit 3), as <br />authorized via Santa Ana Municipal Code Section 2-706 Sale to Owners of Adjoining <br />Property, and Section 2-709 Exceptions to transfer ownership of substandard vacant <br />land. <br />FISCAL IMPACT <br />Costs for maintaining vacant lots have escalated over the years, with frequent <br />maintenance charges for installation, rental fees, damaged material replacement fees, <br />and emergency fencing requests.
