3. Hearing Officer: The Chief of Police shall act as the hearing officer. The meeting <br />shall take place within twenty-one (2 1) calendar days of the date the employee filed <br />the appeal or such other time as may be agreeable by the parties. <br />4. Decision: After the meeting, a decision will be submitted in writing within thirty <br />(30) calendar days and provided to the employee. The decision is final. The decision <br />shall advise the employee that the time within which judicial review of the decision <br />may be sought as governed by Code of Civil Procedure § 1094.6. <br />16.4 The appeal of performance evaluations shall be subject to a one (1) step appeal to the Chief <br />of Police or City Manager or designee (depending on who made the decision) as <br />determined by the Executive Director of Human Resources or designee. Such requests for <br />appeal shall be submitted in writing to the Executive Director of Human Resources or <br />designee within ten (10) calendar days from the date the employee received the <br />performance evaluation. The Chief of Police or City Manager or designee shall meet with <br />the employee within ten (10) calendar days after submission of the appeal. The Chief of <br />Police or City Manager or designee shall deliver the written response to the employee <br />within ten (10) calendar days after meeting with the employee. The decision of the Chief <br />of Police or City Manager or designee shall be final and binding. <br />16.5 Employees may be represented by up to two (2) representatives of their choice when <br />entitled to a representative by law (for example, one (1) attorney and one (1) Association <br />representative, or two (2) Association representatives). <br />16.6 The parties can mutually agree to extend any deadlines in this Article. <br />59 <br />
