b. Unless both parties agree otherwise, arbi- <br />tration will take place in the county in which <br />the "insured" lives. Local rules of law as to <br />arbitration procedure and evidence will ap- <br />ply. The decision of the arbitrator will be <br />binding. <br />E. Additional Definitions <br />1. The following words and phrases have special <br />meaning for California Uninsured Motorists <br />Coverage — Property Damage: <br />a. "Auto" means a self-propelled motor ve- <br />hicle. However, it does not include: <br />(1) A vehicle transporting persons for hire, <br />compensation or profit other than van <br />pool vehicle; <br />(2) A vehicle designed, used or maintained <br />primarily for the transportation of proper- <br />ty; or <br />(3) "Mobile equipment". <br />b. "Property damage" means injury to or de- <br />struction of a covered "auto". However, <br />"property damage" does not include loss of <br />use. <br />2. As used in this endorsement: <br />"Uninsured motor vehicle" means a land motor <br />vehicle or trailer that is involved in a collision <br />with a covered "auto" and for which: <br />a. No liability bond or policy at the time of an <br />"accident" provides at least the amount re- <br />quired for "property damage" liability by the <br />California Financial Responsibility Law; or <br />b. The insuring or bonding company denies <br />coverage or refuses to admit coverage ex- <br />cept conditionally or with reservation or be- <br />comes insolvent. <br />The collision must involve direct physical con- <br />tact between a covered "auto" and the "unin- <br />sured motor vehicle" and: <br />a. The owner or operator of the "uninsured <br />motor vehicle" must be identified; or <br />b. The "uninsured motor vehicle" must be <br />identified by its license number. <br />However, "uninsured motor vehicle" does not <br />include any vehicle: <br />a. Owned or operated by a self -insurer under <br />any applicable motor vehicle law, except a <br />self -insurer who is or becomes insolvent <br />and cannot provide the amounts required <br />by that motor vehicle law; <br />b. Owned by the United States of America, <br />Canada, a state or political subdivision of <br />any of those governments or an agency of <br />any of the foregoing; or <br />c.
