PI-CA-032 CA (05/21) <br />covered "auto" must be out of service because of its breakdown, repair, servicing, "loss" or <br />destruction. <br />c. Anyone for damages he or she is entitled to recover because of "bodily injury" sustained by <br />another "insured". <br />2. A partnership, limited liability company, corporation or any other form of organization, then the <br />following are "insureds": <br />a. Anyone "occupying" a covered "auto" or a temporary substitute for a covered "auto". The <br />covered "auto" must be out of service because of its breakdown, repair, servicing, "loss" or <br />destruction. <br />b. Anyone for damages he or she is entitled to recover because of "bodily injury" sustained by <br />another "insured". <br />C. Exclusions <br />This insurance does not apply to any of the following: <br />1. Punitive or exemplary damages. <br />2. Any claim settled without our consent. However, this exclusion does not apply to a settlement <br />made with the insurer of a vehicle described in Paragraph b. of the definition of "uninsured motor <br />vehicle". <br />3. In any instance where it would directly or indirectly benefit any insurer or self -insurer under any <br />workers' compensation, disability benefits or similar law or to the direct benefit of the United <br />States, a state or its political subdivisions. <br />4. "Bodily injury" sustained by: <br />a. An individual Named Insured while "occupying" or when struck by any vehicle owned by that <br />Named Insured that is not a covered "auto" for Uninsured Motorists Coverage under this <br />coverage form; <br />b. Any "family member" while "occupying" or when struck by any vehicle owned by that "family <br />member" that is not a covered "auto" for Uninsured Motorists Coverage under this coverage <br />form; or <br />c. Any "family member" while "occupying" or when struck by any vehicle owned by the Named <br />Insured that is insured for Uninsured Motorists Coverage on a primary basis under any other <br />coverage form or policy. <br />However, Exclusion 4. shall not apply to "bodily injury" sustained by an individual Named Insured or <br />"family member" when struck by a vehicle owned by that "insured" and operated or caused to be <br />operated by a person without that "insured's" consent in connection with criminal activity that has <br />been documented in a police report and to which that "insured" is not a party to. <br />5. "Bodily injury" sustained by an individual Named Insured or any "family member" while <br />"occupying" any vehicle leased by that Named Insured or any "family member" under a written <br />contract for a period of six months or more that is not a covered "auto". <br />6. Anyone using a vehicle without a reasonable belief that the person is entit <br />7.
