In Re <br /> <br /> Protest <br /> <br />Resolution Overruling <br />~rotest No. 12~1. <br /> <br />In Re <br /> <br />Resolution Ordering Work <br /> <br />No. 12V2 - W. 5rd St. <br /> <br />In Re <br /> <br />Resolution Ordering Work <br /> <br />ho. 12V3 - Oak St., et~ 1 <br /> <br />t~his being~the day~-hou'r a nd place f~xed by the Board of <br />Trustees end set forth in Resolution of Int~tion No.1258 <br />when and where my and all persons having any objection to <br />the work or improvement proposed by Resolution of Intention <br />No. 1258 might appear before the Board of Trustees and show <br />cause wh~ the saidproposed improvement should not be carried <br />out, and the Board of Trustees being now ir~ session st a <br />regular adjourned meeting thereof proceeded to hear and Pass <br />upon all p~teata presented. <br /> <br /> It a~pearing t hat a protest was filed by Art Radl ey <br />against the proposed ~rkand against the ext~t of the dls- <br />trict to be assessed, said w oteat was duly referred to the <br />Engineer ~ r checking. The Engineer reported that pr ct'est <br />pepresented onl~ i0.7% of t~e frontage involved in the im- <br />provement. The protest and report of the Engineer was ch ly <br />considered, and passed upon ~.the Board of Trustees and <br />overruled and denied. <br /> <br /> Trustee Neff thereupon introduced a resolution overruling <br />and denying ~& proteata:~gaihat~he?-prop~ ed improvement of <br />West Third Street~ the resolution was ordered filed, reed, <br />considered, designated Resolution Overruling Protest No.1271 <br />and passed by the following vote: <br /> <br /> Ayes: Trustees C.~.Chapman, E. B. Collier, NAT N. Neff. <br /> Noes: Trustees None. <br /> <br /> Absent: Trustees Geo. McPhee, ~. W. Tubbs. <br /> <br /> . <br /> <br />&ll protests having been duly overruled and denied, the Boar~ <br />of Trustees deemed that they l~d acquired Jurisdiction to <br />order the proposed improvement upon a p~ ti on of West Third <br />Street, and thereupon, Trustee Neff introduced a resolution <br />ordering the work. The resolution was ordered filed, read, <br />considered, designated Resolution Ordering Work No. 1272 <br />and passed by thefollowlng vote: <br /> <br /> Ayes: Trustees C.H.Chapman, E.B.Oollier, Nat H. Neff. <br /> <br /> Noes: Trustees None. <br /> <br /> Absent: Trustees Oeo. MoPhee, <br /> <br />This being the time and place fixed <br />tion of Intention ~o. 1250 to order <br /> <br />J. W. Tubbs. <br /> <br />and set forth in hesolu- <br />work done and improvement <br /> <br />made upon portions of Oak St., Bishop St., Gr~t St., Wakeham <br />Ave. and ~arwood Place, and the Boax~d of Trustees being d~ly <br />convened in open session, proceeded to hear and pass upon all <br />protests.
