RESOLUTION N,o. 1922 A RESOLUTION OHDER£NG THE STREET ouF~qlNTENDENT TO ABATE THE PUBLIC NUISANCE HERETOFORE DECLARED BY THE CI'I~ COUNCIL OF THE OI'l~ OF ~ANTA ANA TO EXIST IN THE CITY OF SANTA ANA, TO-~IT: Yd~EDS WHICH BEAR SEEDS OF A W±N~Y OR DOV~NY NATURE AND ATTAIN SUCH A LARGE GRO~H AS TO ~ECO~E A FIRE MENACE WHEN DRY AND '~ICH ARE NOXzOUS AND DANGEROUS, GROWING UFON CERTAIN STREETS, SIDE~ALK~ AND PRIVATE PROPERTY IN THE CITY OF ~ANTA ANA, BY HAVING THE WEEDS REFERRED TO REMOVED. follows: The City Council of the City of Santa Aha, ~esolves as Section 1. Pmrsuant to the provisions of an Act of the Legislature of the State of California, entitled "An Act Authorizing Municipalities to Declare Noxious or Dangerous Weeds Growing upon the Streets or Sidewalks or Private Property within Municipalities to be a Public Nuisance, Creating a Lien upon the Property Fronting upon such Streets or Sidewalks or upon which such Nuls~ce Exists for the Cost of Abating the Same", approved May 26, 191~, and amend- ments thereto, the City Council of the City of Santa Ana having acquired jurisdiction so to do, hereby orders the Street Superintend- ent of said City to abate the public nuisance heretofore declared to exist in said City of Santa Ana, to-wit: Weeds which bear seeds of a win~ or downy nature and attain such a large growth as to become fire menace when dry and which are noxious and dangerous, growing upon the st2eets or sidewalks in front of or upon private property described as follows, to-wit: ( SEE V~ED FILE ) Section ll. Any property owner shall have the right to have any of said weeds removed at his own expense, providing the sa~ is done prior to ~he arrival of the Street Superintendent or his representatives to do the same. Section lll. The Street Superintendent shall keep an acco~ of the cost of abating said nuisance in front of or on each separate lot or parcel of land where the work is done by him or his deputies~ and shall render an iten~ized report, in writing to the City Council of ~he City of Santa Ana showing the cost of removing such w~eds on each separate lot, or in front thereof, or both, provided, ~hat before said report is ~ubmitted to said City Council, a copy of ~he same shall ce posted for at least three days, prior thereto, on or neap ~he Chamber Door of said City Council, together with a notice of ~he time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiving and considering said report, the City Council shall hear the same, together with any objections which may be raised by any of ~he property owners liable to be assessed for the work of abating s aid nuisance and thereupon n~ such modifications in the report as they deem necessary, after which said report shall be confirmed. The amounts of the cost for abatin such nuisance in front of or upon the various ~rcels of land mentioned in said report shall constitute spe cial assessments agains ~t ~ke
