<br /> WHEREAS, the City Council of the City of Santa Ana, on the 22nd day of Octobe~
<br /> 1928, passed its Resolution of Intention No. 20~8, to order the hereinafter described
<br /> work to be done and improvement to be made in, on and along Bir~h Street from the
<br /> center line of Falrview Avenue to the ~orth line of Tract No. 552 and Russell Avenue
<br /> from the West line of Broadway to the East llne of Ross Street, which Resolution of
<br /> Intention No. 2026 was dul~ and legally published twice in the Santa Ana Daily Evening
<br /> Register, a daily newspaper published and circulated in the City of Santa Ana, all as
<br /> required by law, as appears from the affidavit of W. Lee Nfl].fs, principal clerk of
<br /> the printers and publishers of said daily ne~,~'~:paper, and which affidavit was filed in
<br /> the office of the Clerk of the City of Santa ~na, on the 28th day of October, 1928;
<br /> and
<br />
<br /> WHER'~,~S, after the passage and adoption of said Resolution of Intention No.
<br /> 2026, the Street Superintendent of the City of Santa Ana conspicuously posted along the
<br /> line of the conte:~_~plated work and improvement, at not ~ore than three hundred (500) feet
<br /> in distance apart, and 15 in all, notices of the passage of said Resolution of Intent-
<br /> ion, headed, NOTICE OF I~.IPROV~E}.~ENT, in the manner, form and substance as r equfred by
<br /> law, and the work being chargeable upon a district, also conspicuously posted copies
<br /> of s~Id notice along all of the open streets within such district at not more than three
<br /> hundred (~00) feet in distance apart, as appears from the affidavit of C.L.Jenken, said
<br /> Stl'eet Superintendent, who personally posted said notices of improvement; and
<br />
<br /> %'~tEREAS, the Street Superintendent ~£ the City of Santa Ara, commenced to
<br /> post said notices on the 8th day of October, 1928, and fully completed the posting
<br /> thereof on the 8th day of November, 1928, more than ten (10) days before the date set
<br /> for hearing protests or objections to the proposed work and improvement, all as appears
<br /> from the affidavit of C.L.Jenken, Street Superintendent, of the City of Santa Ana, filed
<br /> in the office of the Clerk of said City on the 8th day of November, 1928, and now on
<br /> file therein; and
<br />
<br /> WHEREAS, the City Council of the City of Santa Ana was duly and regularly
<br />
<br />in session at the Council Chamber thereof at the hour of 7:~0 o~clock P.N. on ~onday,
<br />the 19th day of November, 1928, being the time, hour and place named in the Resolution
<br />of Intention and Notice of Improvement, when and where any and all persa~ s having any
<br />objection to the proposed work or in~provement may appear before the City Council and
<br />cause why said proposed work should not be carried out in accordance with said
<br />Resolution of Intention No. 2026; and
<br />
<br /> ~{EREAS, all protest-.s or objections presented having been disposed of, over-
<br />ruled and denied, in time, manner and form as required by law, and the City Council of
<br />the City of Santa Ana having acquired jurisdiction to order the proposed work done and
<br />improvement made;
<br />
<br /> IT IS HEREBY RESOLVED, by the City Council of the City of Santa Ana, that
<br />
<br />the public interest and c~nvenience reqttires the work done and improvement made part-
<br />icularly set forth and described in Resolution of Intention No. 2026, which is dated
<br />the 22nd day of October, 1928, on file in the office of the Clerk of said City and
<br />hereby referred to and made a part hereof, and the Cl. ty Council of the City of Santa Ana
<br />hereby orders the work to be dma e and improvement to be made in said City, as part-
<br />icularly set forth and described in the said Resolution of Intention No. 202,6 as aforesa
