RESOLUTION NO. 2237 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE. CITY OF <br />SANTA ANA, CALIFORNIA, RELATING TO THE ISSUANCE <br />OF STREET IMPROVEMENT BONDS PURSUANT TO RESOLUTION <br />OF INTENTION NO. 2148; ~ETERMINING THE AMOUNT OF <br />UNPAID ASSESSMENTS; PRESCRIBING THE IENOMINATION OF <br />SUCH BONDS AND PROVIDING FOR THEIR ISSUANCE IN <br />ANNUAL SERIES. <br /> <br /> WHEREAS, pursuant to Statute, notice of the filing of list of unpaid <br />assessments was duly given in the manner and form required by law, that the <br />warrant, assessment and diagram was recorded on the 22nd day of July, 1~30, for <br />the work and improvement made by George H. Oswald, under that certain contract <br />awarded to him on the 30th day of December, 1929, upon portions of Flower Street, <br />Nineteenth Street, Heliotrope Drive, Santa Clara Avenue, Ross Street, Victoria <br />Drive, Greenleaf Street, Seventeenth Street and North Park Boulevard, ~s set <br />forth in Resolution of Intention No. 2146; and that said warrant, assessment and <br />diagram were returned to the Street Superintendent of said City, together with a <br />written statement of all paym?nts received upon the said assessment; and after the <br />~ll expiration of thirty (30) days after the date of recording of said warrant, <br />the said Street Superintendent duly made and filed with the City Clerk of said <br />City of Santa Ana, a complet list of all assessments unpaid upon the said assess- <br />ment, which list is now on file in the office of the City Clerk of said City; <br />now upon evidence shown, this City Council determines that the assessments therein <br />mentioned were then unpaid; the to~al aggregate thereof being the sum of Seventy- <br />four thousand seven hundred eighty two and 72/100 Dollars ($74,782.72~, and that <br />there has been paid since the filing of the list of unpaid assessments by the <br />Street.Superintendent the following.assessments, to-wit: Assessment No. 2 for <br />$58.88, Assessment No. 3 for $17.93, Assessment No. 111 for $51.04, Assessment No. <br />198 for $10.21; Assessment No. 199 for $76.87; Assessment No. 200 for $61.04, and <br />that there now remains unpaid the sum of Seventy-four thousand five hundred <br />seventeen and S/lO0 Dollars ($74,51V.05) upon the assessments shown upon said list. <br /> <br /> Reference is hereby made to Resolution of Intention No. 2146 of the City <br />Council of the City of Santa Ana, passed on the 12th day of November, 1929, for a <br />complete description of the work herein mentioned, Mud to the list of unpaid <br />assessments filed as above stated for the assessments unpaid; and <br /> <br /> ~REAS, interested persons were notified in the manner required by law <br />to appear before the City Council in the Council Chamber of the City Hall of said <br />City, at the hou~ of 7:30 otclock P~M. on Tuesday, the 2nd day of September, 1930, <br />and show cause why bonds should not be issued upon the security of the unpaid <br />assesmments ahewn on the Street Superintendent~s list; and there being no <br />Trustees present at the regular meeting of said City Council held on the 2nd day <br />of September, 1930, said meeting ~as regularly adjourned by the Clerk, and the <br />1Sth day of September, 1930, at 7.30 o~clock P.M. in the Council Chamber of the <br />City Council was the next regular meeting of the City Council, at which time said <br />matter came on regularly for hearing; and <br /> <br /> WHEREAS, notice was duly given in the ~nner and form required by law~ <br />that serial bonds to represent unpaid assessments bearing interest at the rate of <br />six percent per annum will be issued hereunder in the manner provided in the <br />"Improvement Bond Act of 1916", the last installment of which bonds shall mature <br />nine years from the 2nd day of Ju~y next succeeding ten (10) months from their <br />date, and all interested persons having appeared before this City Council and <br />having been given a full opportunity to show cause why bonds should not be issued <br />upon the security of the unpaid assessments shown on said list, and all obJeotion~ <br />presented having been heard and considered. <br /> <br /> IT IS THEREFORE NOW BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, <br />DETERMINED, RESOLVED AND ORDERED AS FOLLOWS: <br /> <br /> That no cause has been shown why bonds should not be issued upon the <br />security of said unpaid assessments, and does hereby overrule all objections <br />thereof, and does hereby direct the issuance of said bonds; and further. <br /> <br /> BE IT RESOLVED AS FOLLOWS: That bonds shall be issued upon the security <br />of said unpaid assessments to said amount of Seventy-four thousand five hundred <br />seventeen and 6/100 Dollars ($74,517.06). <br /> <br /> That said bonds shall be eighty (80) in number and shall be dated <br />September 16, 1930, and bear interest at the rate of six percent per annum, and <br />the denomination of said bonds, and the date of respective maturity thereof shall <br />be as follows: <br /> <br />SERIES BOND NO.
