<br /> WHEREAS, the City Council of the City of Santa Ana, on the 7th day of
<br /> November, 1938, passed its Resolution of Intention No. 2601 to order the hereinafter
<br /> described i~provement to be made and public work to be done in the City of Santa Ana~
<br /> and
<br />
<br /> WHEREAS, after the passage and adoption of Resolution of Intention No. 2601,
<br /> the Street SuperlntenSent of the City of Santa Ana conspicuously posted along the
<br /> line of the contemplated work and improvement at not more than three hundred ~eet in
<br /> distance apart, and three in all, notices of the passsge of said resolution of
<br /> Intention headed NOTICE OF PUBLIC WORK, in the manner, form and substance as required
<br /> by law, and said Street Superintendent also caused a notice, similar in substance, to
<br /> be published for a period of ten days in the Orange County Reporter, a daily newspaper,
<br /> published and circulated in the City of Santa Ana and named by the City Council in
<br /> said Resolution of Intention as the paper in which said notice should appear, all as
<br /> appears from the affidavit of W.P.Hagthrop, the printer and publisher of said daily
<br /> newspaper, and which affidavit was filed in the Office of the Clerk of the City of
<br /> Santa Ana, on the 30th day of November, 1938, rand is now c~u file therein; and
<br />
<br /> WHEREAS, the Street Superintendent of the City of Santa Aha cGnmenced the
<br /> posting of the notices hereinbefore referred to on the 14th day of November, 1938, and
<br /> fully completed the posting thereof on the 14th day of November, 1938, as appears from
<br /> the affidsvlt of J.L.McBride, Street Superintendent of the City of Santa Ana, and more
<br /> than ten days having expired after the expiration of the time of the publication of sai,
<br /> notice within which protests or objection to the proposed work, or improvement, might
<br /> be made by any person interested, objecting to said work or improvement, or to the
<br /> extent of the district or lands to be affected or benefited by said work or improvement
<br /> and to be assessed to pay the costs or expenses thereof; and
<br />
<br /> WHEREAS, at the next meeting of the City Council, after the expiration of
<br />said ten (lC) days after the expiration of the time of the l~UbIication of said notice,
<br />and no objection to said work or improvement having been made or on file, why said
<br />proposed improvement should not be carried out in accordance with said Resolution of
<br />Intention, the City Council of the City of Santa Ana, having now acquired Jurisdiction
<br />to order the proposed improvement;
<br />
<br /> IT IS HEREBY RESOLVED AND ORDERED that the pUblic interest and convenience
<br />require the work hereinafter described and the City Council of the City of Santa Ana
<br />hereby orders the following work to be done and improvement made in the City of Santa
<br />Aha, as follows:
<br />
<br /> That that portion of Heliotrope Drive, as hereinafter described, in the City
<br />of Santa Ana, be closed up and abandoned, to-wit:
<br />
<br /> All of the North 424 feet of Heliotrope Drive as shown on
<br /> Tract No. 1010 as per map thereof, recorded in Book 33,
<br /> page 15, Miscellaneous Maps, Records of Orange County,
<br /> California, not included within Heliotrope Drive as shown
<br /> on Tract No. 1035 as per map thereof recorded in Book 33,
<br /> page 46, Miscellaneous'Maps, Records of Orange County,
<br /> California.
<br />
<br /> That the public work ordered and the improve~e nt to be made is for the
<br />purpose of closing up and abandoning that portion of Heliotrope Drive as hereinbefore
<br />described and for that reason no district is chargeable therewith.
