47f <br /> <br /> RESOLUTION NO. 2814 <br /> <br /> A RESO~UT!0N OF THE CITY COUNCIL OF THE <br /> CITY OF ~ANTA ANA DECLA~RING ~tEIR INTENT~ <br /> I0N OF THE CLOSING UP AND AB~ANDON~"NT OF <br /> A STREET LOCA'±'mD BE~VEEN MAYBURy STREET IQ.T~WN <br /> AS EAST SIXTH STRI~;T, HERETOFOEE DEDICA'I*:u <br /> FOR SAID PURPOSES TO T~E CITY OF SANTA ANA <br /> DECLARING IT TO BE FOR THE BEST INTERESTS <br /> AND CONVENIENCE AND FIXING THE Tl%~ AND <br /> ~LACE FOR HEARING OBJECTIO~{S TO SAID PROPOSED <br /> I~,~ROVE~ENT <br /> <br /> The City Council pursuant to the provisions of an Act of the Legislature <br /> of the State of California, known as "Street Improvement Law of 1889", approved <br /> March 6, 1889, Statutes of 1889, p. 70, and smendments thereto, do resolve and <br /> declare as follows: <br /> <br /> SECTION 1: That the best interest and convenience requires the closing <br />up and abandonment of two Ten (10) foot strips being the Southerly Ten (10) feet <br />and the Northerly Ten (10) feet of East Sixth Streot, formerly known as Central <br />Avenue, running East and West between the east line of Grand Avenue and the west <br />line of Maybury Street, excepting therefrom the areas within the intersections of <br />McClay, Linwood, and Eastside Streets, as hereinafter particularly described, <br />heretofore dedicated for street purposes in the City of Santa Aha, Orange County~ <br />California, and <br /> <br /> It is the intention of the City Cotmcil of the City of Santa Aha to <br />order that portion of the street hereinafter described to be ¢10sed up and <br />abandoned; said portion is particularly described as follows, to-wit: <br /> <br /> Two strips of land being the Northerly Ten ~10) <br /> feet and the Southerly Ten (10) feet of the existing <br /> Eighty (80) feet in width of East Sixth Street, formerly <br /> known as Central Avenue, conm~ncing at the east line of <br /> Grand Avenue and extending to the west line of Maybury <br /> Street, EXCEPTING therefrom any portion lying w.lthin the <br /> area of the intersections of the following streets; <br /> McClay, Linwood, and Eastside Streets, <br /> <br />all of which is more clearly shown on a certain map approved and adopted by the <br />City Council of the City of Santa Ana for said closing up and abandonment by <br />Resolution No. 2813 on the 17th davy of June, 1940. <br /> <br /> SECTION 2: That the said City Council of the City of Santa Aha do <br />further declare that the roads, lands or premises affected by the closing up and <br />abandonment of the portion of the hereinbefore ~scribed street, and benefitted <br />by said improvement are: <br /> <br /> Lots 5, 6, 7, 8, 9, 11 and 12 of the <br /> Eastside Addition as per Miscellaneous Recorded <br /> Maps in B_ok 1, at Page 21, Records of Orange <br /> County, C~lifornia, and <br /> <br /> Lots 1, 30 and 31 in Tract 319 as recorded <br /> in Book 14, at Page 37 of ~iiscellaneous Maps, <br /> Records of Orange County, California, and <br /> <br /> Lot 1, in T~act 339 as recorded in Boo~ 16~ <br /> Page 8 of Miscellaneous Maps, Records of Orange <br /> County, California. <br /> <br /> SECTIOI~ 3: That the proceedings for the closing up and abandonment of <br />that portion of the aforesaid street shall be had and taken under and in accord- <br />ance with an act of the legislature of the State of California desi£~nated snd <br />kno~n as "AN ACT TO PROVIDE FOR LAVING OUT, oPE~II4G, EXTENDING, IV!DENING~ <br />STRAIGHTENING, OR CLOSIN~- UP IN V~HOLE OR !N PART ANY STREET, SQUARE, LANE, ALLE~/, <br />COURT OR PLACE WITHIN ~NI~ICIPAL!TIES~ AND TO CONDEMN AND ACQUIRE ANY AND ALL LAND <br /> <br /> <br />
