have been deeded to the State of California· mad are at present completely off <br /> the assessment rolls of the City of Santa Aha and the County of Orange, and <br /> will produce NO TAX REVENUE until some effective plan is worked out to get the <br /> taxes and assessments brought up to date and the property back into the hands <br /> of private owners who will pay the current taxes ~ad assessments as they become <br /> due. <br /> <br />The group of lots included in this plan are scattered throughout the City and <br />are all encumbered with 1915 Act Bonds, for Paving, Street Lights, Sewers· etc. <br /> <br />It has been necessary to levy annually a rate of ten cents per hundred, assessed <br />value, on ALL .property within the City Limits· to pay the amounts due under the <br />various 1915 Act Bonds of the City of Santa Ana, now in default. <br /> <br />The successful working of this plan will place these lots back on the assessment <br />rolls of both the City and the County and will help, elim~inate the ten cent levy <br />now required to service the delinquent 1915 Act Bonds. <br /> <br />This plan, in general, is as follows: <br /> <br />(a) The City of Santa Aha will purchase from the County of Orange, under Section <br />389V-d of the Political Code, and amendments thereto, the tax title now held by <br />the State of California, subject however, to the approval of the State Controller. <br />At this point the State Tax Title and the City Tax Lien will both be vested in the <br />City of Santa Ana. <br /> <br />(b) The City of Santa Aha will the~ offer to the record o~er of each lot sc <br />purchased from the County· a small sum of money in cash for a Quitclaim deed to <br />such lots. At this ppint the City will have a good and marketable title to <br />any such lots for which it holds Quitclaim deeds, thereupon the City will cancel <br />all City Taxes and Penalties, to d ate, against such lots. <br /> <br />(c) Where Quitclaim deeds to the lots involved in this sale are not <br />quickly and at a very small cost· the City will immediately institute <br />action to quiet its title to such lots as are secured under tax deed. <br /> <br />secured <br />a court <br /> <br />(d) Upon the C~urt~s decree,~anting title to the City, (it is expected that <br />most parties wiI1 default by failure to answer the City's Complaint), the City <br />will then hold good title and will then cancel all taxes and penalties outstand- <br />ing against such lots and will then sell such lots to the best advantage of the <br />City. <br /> <br />(e) If it is found that some of these lots cannot be sold for the full amount <br />of the improvement bonds outstandingsgainst them, then it is the intention of the <br />City of Santa Ana to make such sales at the best price obtainable on the present <br />market, so as to get this property back on the assessment rolls. <br /> <br />60 <br /> <br />Section 4 of the Assembly Bill 1129, being Chapter No. 396 of the Statutes of <br />1935, is pertinent to this plan and reads as follows: <br /> <br />"The facts constituting such necessity are as follows: <br /> Due to the depression which has existed in the past <br /> several years, many lahd-owners have been unable to <br /> me&t the takes and assessments levied by the State, <br /> political subdivisions, agencies, reclamations, <br /> drainage and levee districts, wlth the result that <br /> their lands have been sold to the State and such tax- <br /> ing and assessing agencies. The heavy penalties <br /> assessed by law have made it impossible for the land- <br /> owners to redeem their lands, hence, thousands of acres <br /> of land (together with thousands of lots)· have been <br /> sold for the non-payment of such taxes and assessments~ <br /> and deeds have been executed thereon to the State of such <br /> taxing and assessing agencies. That as long as such <br /> lands (or lots) remain State lauds, the same are non- <br /> assessable for tax or assessment purposes, and the tax <br /> and assessment burden becomes heavy upon the paying <br /> lands~ causing more delinquencies and losses * * * * * <br /> The legislature hereby~ declares that the wel~re of the <br /> State requires that such lands (or lots) be placed in <br /> private ownership as promptly as possible so that such <br /> land (or lots) henceforth bear its Just proportion of <br /> current taxation and assessments." <br /> <br />Plan Dated August, 1st, 1940. <br /> <br /> AGREEMENT, OF SALE AND PURCHASE, <br /> <br />THIS AGP~EEMENT made and entered into as of this 5th day of August · 1940· by and <br /> <br />BETWEEN: <br /> <br /> <br />
