RESOLUTI0~Q N0. 2790 A RESOLUTION ORDERING TITE STRE~i~T SUPERINTENDENT TO ABATE THE PUBLIC NUISANCE HERETOFORE DECLARED Tti~ CITY COUNCIL OF THE CI?Z OF SANTA ANA, TO-WIT: WEhI)S WHICH BEAR S~S OF A %VINGY OR DOWh~ NATURE AND ATTAIN SUCH A LARGE GROWTH AS TO BEC0~ A FIRE MENACE WHEN DRY AND WHICH ARE NOXIOUS AND DANG~ROUS~ GROWING UPON CERTAIN STREETS, SIDEWALKS AND PRIVATE PROPERTT IN THE CITY OF SANTA ANA, RY HAVING THE WEEDS REFEREED TO THE CIT~ COLrMCIL OF THE CITY OF S~d~TA ANA DO RESOLVE AS FOLLOWS: SECTION 1: Pursuant to provisions of an Act of the Legislature of the State of California~ entitled "An Act Authorizing Mttnicipalities to Declare Noxious or Dangerous Weeds Crowing upon the Streets or Sidewalks or Private Property within Municipalities to be a Public Nuisance~ Cr~tzng a Lien upon the Property Fronting upon such Streets or Sidew:~lks or upon which such Nuisance Exists for the Cost of Abating the Same", a?proved May 26, 1915, and amendments thereto, the City Council of the City of Santa Ana, having acquired jurisdiction so to do~ hereby orders the Street Superintendent of said Cityto abate the public nuisance heretofore declared to exist in said City of S~nta Ano, to-wit: Weeds which bear seeds of a wingy or downy nature and attain such a large growth as to become a fire r~en~ce when d~y and which are noxious and dangerous~ growing upon the streets or sidewalks in front of or upon all that private property described in Resolution Mo. 2776 of the City Council of the City of Santa Ana passed and adopted on tho 18th day of I'~arch~ 1940, to which Resolution reference is hereby ~ade for further particular description of said private property. SECTION 2: Any property owne~ shall have the right to have any of said weeds removed at h_s eyre expense, providing the s~me is done prior to the arrival of the Street Superintendent or his representatives to do the same. SECTION 3: The Street Super~nte~dent shall keep an account of the cost of abating said nuisance in front of or on each separate lot or parcel of land where the work is done by hi~a or l:ic deputi~s~ and shall render an itemized report~ in writing to the City Council of the City of Santa Aha sSowing the cost of removing such weeds on each separate lot, or in front t~reof~ or both~ provided that before said report is submitted t o said City Council~ a copy of the same shall be posted for at least three (3) ,ays prior thereto, on or near the Chmmber Door of said City Council, togethe with a notice of the time when said report shall be submitted to the City Council for confirmation. At the time fixed for receiv~n~g and considering said report~ the City Council shall hear the same, together wibh any objections which may be raised by auy of the property ~n~ers liable to be assessed for the work of abating said nuis~nce and thereupon make such modifications in the report as they deem necessary~ after which said report shaI1 be confirmed. The amounts of the cost for abatLuo such nuisance in front of or upon the v ario~,,s parcels of laud mentioned in said report shall constitute special assessments against the respective parcels of laud, and~ as is ~de and confirmed, shall constitute a lien on said property for the amount of such assessments~ _ respect~vely~ and. thereafter s~id ametuuts shall be colUected at thee same time an¢3 ~n th same molkuer as ordinary municipal taxes are collected and shall be subject to the same penalties and the same procedure under foreclosure and sale in ca~e of delinquency as provided for ordinary municipal t axes.
