THIS AGI~EEMENT, made and entered into by and between the <br />CZTY OF ~NTA&NA, a municipal corporation, First Party, m~d ~.T <br />C. ROGERS and JUNA ROGERS, his wife, Second Parties, <br /> <br /> WHEREAS, Second Parties have presented to the First Party <br />a grant deed for acceptance, covering that certain real property <br />hereinafter described; and <br /> <br /> W~E~EAS, it is the desire of First Party to accept said <br />deed, and in consideration of which Second Parties are to make <br />certain improvements in and upon said property and Towner Street, <br />which is contiguous to properties owned by Secom~ Parties; <br /> <br /> IT IS AGREED ~hat in consideration of First Party's <br />acceptance of the grant deed covering the properties hereinafter <br />desorib®~, Second Parties agree to install sewer laterals to the <br />properties owned by them contiguous to Towner Street and construct <br />curbing and sidewalk and asphaltic pavement between the curb line <br />and the existing oil surface, all of said installation and construc- <br />tion to be at the sole cost and expense of Second Parties and~ln <br />accordance with specifications to be approved by the City Engineer. <br /> <br /> The property to be accepted by the City and referred to <br /> <br /> in this agreement is situated in the City of Santa Aha, Orange County, <br /> California, and described as follows: <br /> <br />An easement for street purposes over a strip of land 30.00 <br />feet in width, being the East 30.00 feet of that certain <br />parcel of land as described in deed recorded March 3rd, <br />19~3, in Book 1153, page 15, Official Records, Orange County, <br />California, said parcel being described as: <br /> <br />Beginning at a point 379.50 feet North and 775.50 <br />feet East of a stone set at the Southeast corner <br />of land Sold and conveyed by Elizabeth Ross to <br />Washington Baker on June 10th, IGSl, said point of <br />beginnAng being the Nort2xeast corner of two acres <br />of land conveyed by Agusta E. Towner to William <br />Knight; thence North 539.00 feet to the Southeast <br />corner of land formerly owned by D. Edson Smith, <br /> <br /> <br />
