RESOLUTIO~ NO.~_.~_~ RESOLUTION AUTHORIZING E~G~CUTION OF TO 0IL AND GAS RIGP~S. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: WHEREAS, heretofore a deed has been delivered to and accepted by the City of Santa Aha from A. J. Gisler and .Mary A. Gisler, covering the property hereinafter described; and whereas said deed, through inadvertence in drafting, granted to the City a fee title, whereas it was intended there- by to convey to the City and for the City to accept a deed of an easement for sewer purposes only; and whereas it is now proposed by A. J. Gisler and Mary A. Gisler to enter into an oil and gas lease upon certain prop- erty, including the property hereinafter described; NOW THEREFORE, the Mayor and City Clerk of the City of Santa Aha are hereby authorized and directed to execute a grant deed to A. J. Gisler and Mary A. Gisler, for all oil, gas and other hydrocarbon substances, in, upon and under these pieces and parcels of land situate in the County of S California, described as follows: Orange, tate of A strip of land 20 feet in width, being l0 feet on each side of a center line which is 17 feet southeasterly from and parallel to the center line of the 14 feet wide right of way now owned by the City of Santa Ana for its main outfall sewer across Lot 8, Block ~ "~", Tract No. 788. The center line of the said 14 foot right of w~y across Lot 8 is more particularly described as follows: Beginning at the point of intersection of the aforesaid center line with the west line of the northeast one-quarter of Section 53, Tovam- ship 5 South, Range l0 West, which point is South 0e 43t East 1888.98 feet, mere or less, from the one-quarter corner of Sections 28 and 33, TOwnship 5 South, Range l0 West, and is 'engineer's sta- tion 188%78 of the said center line. From the point of beginning the said center line of the said 14 foot right of way runs North 58° 59' East 10~.~7 feet, more or less, to an intersection with the south llne of the north 188 feet of the said Lot 8, Block '~", Tract No. 788. The above described l~ foot right of way is a part of that l~ foot right of way granted to the City of Santa Ana by deed from I. M. Von Schriltz, dated May 23, 1923, and recorded in Book 47S, Page 1~3, Records of Orange County, Said BO feet in width strip of land containing 0.088 of an acre, more or leSSe Grantees, their heirs and assigns, shall have the right o£ ingress and egress over and upon the above described land, but shall not place thereon any derricks, buildings or permanent structures.
