RESOLUTION NO. 3835 <br />RESOLUTION ACCEPTING GRANT DEED <br /> <br />V~IEREAS, FRANK P. BORCHARD RANCHES, a corporation, has <br /> <br />presented to the City Council of Santa Ann, California, a deed <br /> <br />dated August 9, 1949 conveying an easement for all uses and pur- <br /> <br />poses of a public street in, over and upon the real property <br /> <br />situated in the City of Santa Ann, County of Orange, State of <br /> <br />California, and described as follows: <br /> <br /> A strip of land sixty feet in width, the center line of which <br />is described as beginning in the center line of South Flower Street <br />at its intersection with the center line of Edinger Street, as shown <br />on the Map of "Tract No. 352", recorded in Book 15, pages 15 and 16 <br />of Miscellaneous Maps, records of said County, and running thence <br />Southerly in a straight line to the Northwest corner of "Tract No. <br />289", as shown on a Map recorded in Book 14, page 8 of Miscellaneous <br />Maps, records of said County. <br /> Excepting therefrom that part of the West 30 feet of said <br />strip lying Northerly of the South 677.27 feet of said strip. <br /> Also excepting that part within Edinger Street. <br /> <br /> Reserving the perpetual right to conduct water across said <br />strip by means of three underground pipe lines at the locations <br />hereinafter set forth. <br /> <br /> This deed is made, and said strip is granted upon the fol- <br />lowing conditions: <br /> <br /> (a) That grantee, at its sole expense and without any special <br />assessment district, pave and curb the full length of said 60 foot <br />strip, and install a sewer line main (without laterals) therein, <br />within a reasonable time after completion of the storm drain in said <br />strip. <br /> <br /> (b) That grantee, at its sole expense, install three rein- <br />forced concrete underground pipe lines across said strip of at least <br />the same capacity as grantor's existing lines, one near the South <br />line of Edinger Street, one near the North line of the South 677.27 <br />feet of said strip, and one midway between the last mentioned loca- <br />tion and the South line of said strip, each pipe to be in line with <br />grantor's irrigating lines at or near said locations, and said <br />crossing lines to be constructed at such time and manner as not to <br />interfere with necessary irrigation of grantor's orange trees on <br />its adjacent lands. <br /> <br /> (c) That grantee's works near the Northeast corner of said 60 <br />foot strip be covered at grantee's expense at the time of the con- <br />struction of said storm drain. Said works are under two easement <br />deeds, one in Book 1169, page 494 of Official Records, and the other <br />from Frank P. Borchard and wife to the City of Santa Ana, dated <br />August 7th, 1944. That that part of said easements East of the East <br />line of said 60 foot strip shall be cuitclaimed to grantor within a <br />reasonable time after completion of said storm drain. <br /> <br />-1- <br /> <br /> <br />
