RESOLUTION NO. ~849 RESOLUTION AUTHORIZING T~INATION OF OONTRACT PERNITTING NEWPORT BEACH TO USE THE ~INE TUBE El"FENDING INTO THE PACIFIC OCEAN WEEREAS, heretofore on or about the 5th day of October, 1936, an agreement was entered into between the members, con- tracting parties, to the ~oint 0utfall Sewer Agreements and the City of Newport Beach, a Municipal Corporation of the Sixth Class; and WMR~EAS, conditions are now so changed that said members re- quire additional capacity in said sewer pipeline and further pro- pose termination of maintenance and operation of said pipeline. NOW, THEREFORE, BE IT RESOLVED: That the Clerk of the City of Santa Ann be and she is hereby authorized and directed on behalf of the City of Cants Ann to serve upon the City of Newport Beach, a Municipal Corporation of the Sixth Class of the State of California, referred to as and being the Party of the Second Part in and under the provisions of that certain agreement heretofore entered into on or about the 5th day of'October, 1936 by and between said City and those certain Cities and Sanitary Districts which in said agreement are set forth as Parties of the First Part, a notice in writing notifying said City of Newport ~each, that two years from and after s$id service upon said City, said agreement shall cease to be of any further force and effect and that said City of Newport Beach must necessarily be excluded from the use of the submarine tube ending in the Pacific Ocean because of the fact that the Cities and Sanitary DistriCts comprising said First Party, and each of them, require additional capacity in said sewer pipeline and because said Cities and Sanitary Districts comprising said First Party propose to terminate the maintenance and operation of said sewer pipeline and for other valid and sufficient reasons, said notice shall provide
