RESOLUTION NO. 3977 <br /> <br />RESOLUTION GRANTING VARIANCE ON APPLICATION NO. 230 WHERE <br />PLANNING COMMISSION RECOMMENDED DENIAL TO C0~PLY WITH THE <br />PEREMPTORY WRIT OF MANDATE ISSUED BY THE SUPERIOR COURT OF <br />ORANGE COUNTY IN CASE NUMBER 5~112 <br /> <br /> WHEREAS, heretofore, the Planning Commission did hold a pub- <br />lic hearing on the application of Mildred McNeal for a Variance, <br />(Application No. 2301, covering the property hereinbelow described <br />and thereafter recommended to the City Council that said application <br />for Variance be denied for the reasons that the limitations defined <br />in Ordinance No. 107~ for the granting of Variances had not been <br />adequately met; and <br /> <br /> WHEREAS, the City Council on March 20, 1950 instructed the <br />City Attorney to prepare a Resolution granting said Variance; and <br /> <br /> WHEREAS, on~pril 3rd, 1950 the City Council upheld the action <br />of the Planning Commission and denied said Variance; and <br /> <br /> WEEREAS, thereafter a petition for Alternate Writ of Mandate <br />was filed and regularly heard and on the 18th day of July, 1950 a <br />Peremptory Writ of Mandate was issued by the Clerk of the SuDerlor <br />COurt of Orange County in accordance with the Judgment of said Su- <br />perior Court directing that the same be done; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: THAT in compliance with the <br />said Peremptory Writ of Mandate and solely because thereof, the Var- <br />iance is hereby granted covering property in the City of Santa Aha, <br />County of Orange, State of California, anddescribed as follows: <br /> <br /> The east 11.6 feet of Lot 12; the east 11.6 feet except <br /> the north four feet of Lot 11; and the sout~ 102 feet of <br /> Lot 17, all in Tract No. 839, in the City of Santa Ana, <br /> California. <br /> <br />to allow the use of a dwelling house which had been converted for <br />four apartment units, to be used as an apartment ho~se, that is, <br />R-3 Multiple Family use in an. R-1 Single Family Residence District. <br /> <br /> BE IT FURTHERRESOLVED: That the findings required by 0rdl- <br />nance No. 107~ as amended by Ordinance No. 123&, Subdivision <br />are as follows: <br /> <br /> 1. That no special circumstances attach to said property <br /> <br /> <br />
