RESOLUTION NO. 40?4 <br /> <br />RESOLUTION AUTHORIZING COMPROMISE OF LITIGATION <br /> <br /> WHEREAS, heretofore the Young Men's Christian Association of <br />Santa Aha, a Corporation, on Bovember 30, 19~9 paid its property <br />tax under protest and on April 20, 1950 paid a further installment <br />of property tax under protest and thereafter filed a suit against <br />the County of Orange and the City of Santa Ama, the same being case <br />No. 55200 in the Superior Court of Orange County, to recover said <br />taxes and it was thereafter stipulated by and between the Attorneys <br />for the parties, that said litigation would not be brought to trial <br />and would be determined by the final decision in the case of Y.M.C.A. <br />vs County of Los Angeles et al, a case in which all of the issues <br />were identical; and <br /> <br /> WHEREAS, said case has now been decided by the Supreme Court <br />of the State of California and is cited, 35 Cal. 2d 760 and which <br />case was decided in favor of Plaintiff; and <br /> <br /> WHEREAS, an application of the principles laid down in said <br />decision to the cass against the City of Santa Aha would relieve <br />said Plaintiff from the payment of a large portion of the tax in- <br />volved and would entitle it to recover the sum of $300.26 with in- <br />terest at the rate of five percent per annum from the date paid; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Attorney of the <br />City of Santa Aha is hereby authorized and directed to enter into a <br />stipulation with other Counsel in said Case No. 5~200 for a Judgment <br />in favor of Plaintiff in amount of $300.26 with interest from the <br />date of payment of said tax at the rats of Five percent per annum. <br /> <br /> PASSED ANDADOPTED by the City Council of the City of Santa Aha <br />at its regular meeting held on the 3rd day of May, 1951. <br /> <br /> <br />
