OP~DI~AMCE NO. <br /> <br /> AN OB~DINANCE GRANTING TO THE SOUTNEHN PACIFIC <br />RAILWAY COMPANY, A CORPORATION, A FRANCHISE TO CONSTRUCT, <br />OPEP~qTE A~D MAINTAIN A RAILHOAD SPUR TRACK ACROSS <br />EVERGREEN STREET BETWEEN FIRST AND SECOND STREETS, <br />IN THE CITY OF SANTA ANA~ CALIFOP~IA. <br /> <br /> The Board of Trusteea. of the city of Sant~ Ana, <br /> <br />do ordain as follows: <br /> <br /> Section 1. That there is hereby granted to the <br />Southern Pacific Railroad Company, a corporation, and <br />its assigns, the right to construct, operate and main- <br />tain a railroad spur track across Evergreen Street~ <br />between First and Second Streets, in the city of <br /> <br />Aha, Calif~rnia, along and over the route described as <br />follows: <br /> <br /> Beginning at a point in the center line of the <br />Southern Pacific Railroad constructed track in Second <br />Street, said point being 127 feet east of the east <br />line of Evergreen Street, thence westerly through a No. <br />~ frog and switch ~0 ft.. to a point; thence along a <br />curve concave to the left and~having a radius of <br />feet 88 feet to a point; thence~along a line tangent to <br />the last described curve J2 feet to a polnt; thence along <br />a curve concave to the right ~nd ~ving a radius of <br /> <br />~ feet to a point in the west line of Evergreen Street. <br /> <br /> Section 2. The said railroad spur track shall at <br />al~ times conform as near as pr~cticable to the official <br />grmde of said streets as now established or may here- <br />after be established and that the grantee of this fran- <br />chise or its assigns shall at all times keep the road- <br />bed flush with the streets and provided with ~'ood and <br />suitable crossiogs and sh~ plank ~nd macadamize the <br />same between the rails and if t~e streets shall be paved <br />then with the same m~teri,1 as the ~dJoinln~ streets <br />and for at least two feet on eack side thereof whenever <br />and wherever ordered bY t~e Board of Trustees or other <br />legislative body of s~Id City so to do, and in the event <br />of a f~ilure to comply with the requirements thereof for~ <br />ten days after notice so to do then the City will cause <br />its Superintendent of Streets to proceed to construct <br />the required work in good and substantial manner a~d the <br />grantee of this franchise or its assigns by ~cceptance <br />hereof agrees to pay the cost thereof within thirty d~ys <br />after the presentation of ~ bill for the s~me, and the <br />gutters u~on said stre*,ts shall be so constructed upon <br />said <br /> <br />streets as to per,nit the p~ss~ge of storm water along <br /> <br />and under s, id tr~ck. <br /> <br /> <br />
