ORDINANCE N0. lOV5 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />CREATING A CO~.~SSION IN THE SAID CITY <br />0F SANTA ANA, TO BE KNOWN AS THE "THACK <br />REMOVAL C 0MMISSION". <br /> <br />THE COUNCIL OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: <br /> <br /> .SECTION 1: That there is hereby created and established an advisory body <br />for the City of Santa Aha to be known as the "Track Removal Commission". That it shal~ <br />be the duty of the Track Removal Commission to investigate, examine and determine the <br />feasibility of, and endeavor to accomplish the consolidation of steam railroad <br />facilities now serving the City of Santa Ana, and the eltrlnation of unnecessary rights <br />of way and railroad trackage resulting from such elimination; that said commission <br />shal2 investigate and determine the best and most feasible meth~ of accomplishing said <br />purpose, bearing in mind the elimination of unnecessary traffic hazards resulting from <br />grade crossings, and the elimination of unsightly rights of way having railroad tracks <br />extending through what would otherwise be valuable residence property, and also <br />elimination of blind ends of streets which terminate at the rights of way of the <br />railroad tracks now existing in said City. <br /> <br /> SECTION 2: Said track removal commission shall consist of~ not less than nine <br />nor more than fifteen members, at least two of whom shall be members of the City Council <br />of the City of Santa Aha; that the members of such commission shall be appointed by the <br />Mayor of the City of Santa Aha, subject to confirmation by the City Council of said <br />City, and shall serve at the pleasure of the said Council. The exact number of <br />members of such commission shall be determined by the City Council, as evidenced by the <br />number of members appointed to such Commission, and a majority of the members of the <br />Commission at any particular time shall constitute a quorum for the transaction of <br />business. <br /> <br /> SECTION 3: The members of the said commission shall serve without compensati¢ <br />and they shallhave no power or authority as such commission or individuals to incur <br />any indebtedness against the City or assume any responsibility or liability on behalf <br />of said City, but shall act in an advisory capacity only to the City Council in any <br />matters appertaining to the expenditure of money. <br /> <br /> SECTION 4: The City Clerk shall certify to the passage of this ordinance, <br />and shall cause the same t~ be published three times in the SANTA ANA DAILY EVENING <br />REGISTER, a daily newspaper printed, published and clrculated in the City of Santa Aha; <br />and thirty (30) days thereafter shall take effect and be in force. <br /> <br /> PASSED AND ADOPTED by the Council of the City of Santa Ana at its regular <br /> <br />meeting held on the 3rd day of April, 1939. <br /> <br />ATTEST: <br /> E' L.
