AN ORDINANCE REGULATING THE USE OF ORCHARD, NURSERY OR CITRUS Gt~OVE ~S, PROHIBITING CERTAIN TYPES AND PRO- VIDING PENALTY FOR VIOLATION ~A.~, the 0ouncil of the City of Santa Ann hereby finds and declares that the City of Santa A~a and the residents therein have a primary interest in atmospheric purity and freedom of the air from any air contaminates and that there have been from time to time, pollution and toni-ruination of the atmosphere of said City due to discharge of soot, dense smoke, unconsumed, solid carbon- aceous matter and other noxious and deleterious substances from orchard, n~rsery and citrus grove heaters to the detriment of the public health,, safety and general welfare and which has caused ex- tensive damage to the property within said 0ity and constituted a public nuisance therein; and W~A.~, a recurrence of such conditions of pollution and contamination of the atmosphere of said 01fy may be expected unless proper regulation and control be established; NOW, ~EFOR~, T~E 00UNCIL OF THE CITY OF SANTA ANA DOES 0~J]AIN AS FOLLOWS: Section 1: Definitions. (a) Person. "Person" as used in this Ordinance is hereby defined to mean any person, firm, association, organization, partnership, business trust, corporation, company, city, county, municipality, district or other political subdivision. (b) Orchard Heater or Heater. "0rohard Eeater" or "heater" as used in this Ordinance is hereby defimed to mean a machine, bowl, burner or contrivance burning any t2pe of fuel cap- able of emanating carbonaceous matter or other air contaminates, that is used to give protection from frost damage in areas not com- pletely enclosed. (c) Nursery. The word "nursery" as used in this 0rdinanee is hereby defined to mean any place within the City of
