same has been so datermine~ to be by the Extension Service of the <br />University of 0alifornia and does not emit any more solid, carbon- <br />aceous matter or require more frequent cleaning. <br /> <br /> (d) Before any permit may be issued for the 1952-19~3 <br /> heating season, the applicant therefor shall have replaced an addi- <br /> tional one-third of all heaters operated by him, other than pipe <br /> line system or briquet heaters, with University Return Stack Heater, <br /> its equivalent or better as next hereZaabove defined. <br /> <br /> (e) During the heating season of 1953-1955, no orchard <br />heater other than pipe line systems, briquet type heaters or Univer- <br />sity Return Stack Heater, its equivalent or better, as hereinabove <br />in Sub-section (c) defined, shall be used by any person for the pur- <br />pose of providing protection from frost damage in any place not en- <br />tirely enclosed, and no permit shall be issued for any other type of <br />heater during said season or thereafter. <br /> <br /> Seetio2 .~: (a) Any person operating, using or maintaining <br />heaters hereunder, who is in possession of a valid and ,m~evoked <br />permit, shall for the first violation of this Ordinance, have his <br />permit revoked by tha Agricultural Commissioner or other person who <br />may be responsible for the enforcement of this Ordinance but shall <br />not be deemed guilty of a misdemeanor. Regardless of the penalties <br />elsewhere provided for, such first violation shall result only in <br />revocation of the permit. It is the duty of the Agricultural Com- <br />missioner to revoke the permit of any person violating any provision <br />of this Ordinance and if such violator has no permit, then to imme- <br />diately file a criminal complaint against him. Upon the second <br />violation of this Ordinance by any person who holds a permit hare- <br />under, it shall be the duty of the Agricultural Commissioner to im- <br />mediately file a criminal complaint against such person as well as <br />to revoke his permit. No person who has had his permit twice revoked, <br />shall again be granted a permit during the same heating season, and a <br />criminal complaint shall be filed for the second and each succeeding <br />violation on the part of any person regardless of what heating season <br /> <br /> -6- <br /> <br /> <br />
