lng houses, and apartments erected above the ground floor of a <br /> building when said ground floor is designed exclusively for <br /> commercial or industrial purposes. <br /> <br /> Section 3: That Sub-section (c) "Area Exceptions" of Section <br />11 of said Ordinance No. 1074 be amended by adding new Paragraphs <br />thereto at the end of the Part Numbered ~ thereof and before the Part <br />Numbered 5 thereof, to be Numbered ~.5, 4.6 and 4.7 in words and fig- <br />ures as follows: <br /> <br /> "~.5 Yard Regulations modified <br /> a. Since the general yard provisions of this Ordinance have <br /> to be applied to the numerous types of conditions and shapes of <br /> parcels occasioned by varying street layouts and subdivisions of <br /> property, it is not advisable to attempt to define herein, those <br /> cases which warrant exceptions and modifications to the general <br /> yard requirements of this Ordinance; therefore, authority is <br /> hereby given the Building Department as a part of its administra- <br /> tive function, to determine in writing the application of the <br /> specific requirements of this Ordinance in harmony with their <br /> purpose and intent so that the spirit of the Ordinance shall be <br /> observed, public peace, health, safety and welfare secured and <br /> substantial justice done, under the following circumstances: <br /> Where the application of yard regulations cannot be determined <br /> or may be interpreted in more than one way so as to cause con- <br /> fusion in the administration of such regulations or general yard <br /> provisions with respect to irregularly shaped lots such as those <br /> resulting from some angular or curved streets, particularly tri- <br /> angular or gore shaped corner lots, through lots., square corner <br /> lots, trapezoidal lots and lots with more than four lot lines, <br /> such regulations or provisions may be modified or interpreted by <br /> the Building Department, in writing, as to an individual lot or <br /> to all lots of similar type involving s common problem and the <br /> building permit or permits shall be governed by such interpreta- <br /> tion.
