b. The unusual or rapid accumulation of
<br />runoff of surface waters from any
<br />source;
<br />c. Mudslides or mudflows which are
<br />caused by "flood" water. A mudslide
<br />or mudflow involves a river of liquid
<br />and flowing mud on the surface of
<br />normally dry land areas as when
<br />earth is carried by a current of water
<br />and deposited along the path of the
<br />current.
<br />d. The release of water impounded by a
<br />dam, levee, dike, seawall or "flood"
<br />control device, whether driven by
<br />wind or not (including storm surge).
<br />When a "flood" is a continuous or
<br />protracted event it will constitute a
<br />single "flood" occurrence.
<br />24. "Forgery" means the signing of the name
<br />of another person or organization with
<br />intent to deceive; it does not mean a
<br />signature which consists in whole or in
<br />part of one's own name signed with or
<br />without authority, in any capacity, for any
<br />purpose.
<br />25. "Fraudulent instruction" means:
<br />a. An electronic, telegraphic, cable,
<br />teletype, tele facsimile or telephone
<br />instruction which purports to have
<br />been transmitted by you, but which
<br />was in fact fraudulently transmitted by
<br />someone else without your knowledge
<br />or consent;
<br />b. A written instruction (other than those
<br />described in SECTION I - PROPERTY,
<br />A. Coverage, 5. Additional Coverages,
<br />k. Forgery or Alteration) issued by
<br />you, which was forged or altered by
<br />someone other than you without your
<br />knowledge or consent or which
<br />purports to have been issued by you,
<br />but was in fact fraudulently issued
<br />without your knowledge or consent.
<br />26. "Funds" means "money" and "securities".
<br />27. "Fungi" means any type or form of fungus,
<br />including mold or mildew, and any
<br />mycotoxins, spores, scents or by-products
<br />produced or released by "fungi".
<br />28. "Hardware" means a network of
<br />electronic machine components
<br />(microprocessors) capable of accepting
<br />instructions and information, processing
<br />the information according the instructions,
<br />and producing desired results. "Hardware"
<br />includes but is not limited to:
<br />a. Mainframe and mid -range computers
<br />and servers;
<br />b. Personal computers and workstations;
<br />c. Portable electronic devices. Portable
<br />electronic devices include laptops,
<br />tablets, e-readers, smartphones or
<br />other lightweight, hand-held or
<br />wearable devices capable of storing,
<br />retrieving and processing data; and
<br />d. Peripheral data processing
<br />equipment, including but not limited
<br />to printers, keyboards, monitors, and
<br />modems.
<br />"Hardware" does not mean electronic
<br />items that are not similar to the items
<br />listed in a., b., c. and A. above.
<br />"Hardware" does not include:
<br />e. Diagnostic equipment;
<br />f. Electronic items that contain a
<br />computer to perform functions other
<br />than "hardware"; and
<br />g. Peripheral data processing
<br />equipment valued more than the
<br />"hardware" itself.
<br />29. "Hazardous substance" means any
<br />substance that is hazardous to health or
<br />has been declared to be hazardous to
<br />health by a governmental agency.
<br />30. "In transit" means in the course of
<br />shipment from or to the premises shown
<br />in the Declarations. It includes such
<br />shipments while temporarily stopped or
<br />delayed, incidental to the delivery.
<br />31. "Manager" or "managers" means a
<br />person or persons serving in a directorial
<br />capacity for a limited liability company
<br />(LLC).
<br />32. "Media" means an instrument that is
<br />used with "hardware" and on which
<br />"electronic data", "programs and
<br />applications", and "proprietary programs"
<br />can be recorded or stored. "Media"
<br />includes, but is not limited to, films,
<br />tapes, cards, discs, drums, cartridges,
<br />cells, DVDs, CD-ROMs and other portable
<br />data devices.
<br />33. "Member" or "Members" means an
<br />owner of a limited liability company
<br />represented by its membership interest,
<br />who also may serve as a "manager".
<br />34. "Messenger" means you, or a relative of
<br />yours, or any of your partners or
<br />"members", or any "employee" while
<br />having care and custody of property away
<br />from the described premises.
<br />35. "Money" means:
<br />a. Currency, coins and bank notes in
<br />current use and having a face value;
