RECORDING REQUESTED BY, <br />AND WHEN RECORDED MAIL TO: <br />City of Santa Ana ) <br />20 Civic Center Plaza (M-37) ) <br />Santa Ana, California 92702 ) <br />Attn: Housing Manager ) <br />This document is exempt from <br />payment of a recording fee <br />pursuant to Government Code <br />Sections 27383 and 6103. <br />NOTICE OF AFFORDABILITY RESTRICTIONS ON <br />TRANSFER OF PROPERTY <br />This Notice of Affordability Restrictions on Transfer of Property (or "Notice <br />of Affordability Restrictions") is executed and recorded pursuant to the Regulatory <br />Agreement Imposing Affordable Housing Covenants and Restrictions (Density <br />Bonus), recorded on or about , 2024, in the Official Records of San <br />Orange County, against that certain real property generally located <br />at ,in the City of Santa Ana, California ("City") as legally <br />described in Exhibit A hereto ("Property"). The City of Santa Ana, a charter city <br />and municipal corporation ("City"), and <br />(collectively "Homebuyer") have entered into <br />that certain Homebuyer Loan Agreement dated concurrently herewith <br />("Homebuyer Loan Agreement"). <br />1. The Homebuyer Loan Agreement provides for affordability <br />restrictions and restrictions on the transfer of the Property, as more particularly set <br />forth in the Homebuyer Loan Agreement. A copy of the Homebuyer Loan <br />Agreement is on file with City as a public record and is deemed incorporated <br />herein. Reference is made to the Homebuyer Loan Agreement with regard to the <br />complete text of the provisions of such agreement and all defined terms therein, <br />which provides for affordability restrictions and restrictions on the transfer of the <br />Property. <br />2. The Homebuyer Loan Agreement generally provides for City to lend <br />to Homebuyer and for Homebuyer to borrow from City a loan in order to assist <br />1 <br />EXHIBIT E <br />
