Developer shall have such additional time as reasonably necessary to complete such cure, the City
<br /> may perform the necessary maintenance and Developer shall pay all reasonable costs incurred for
<br /> such maintenance. Following the Certificate of Completion for construction of the homes, the
<br /> Property maintenance shall be governed by the provisions of the Regulatory Agreement.
<br /> 5.2 Obligation to Refrain from Discrimination.Developer covenants and agrees for
<br /> itself, its successors, its assigns and every successor in interest to the Property or any part thereof,that
<br /> there shall be no discrimination against or segregation of any person or group of persons on account of
<br /> race, religious creed,color,national origin, ancestry,physical disability,mental disability,
<br /> reproductive health decisionmaking,medical condition,genetic information,marital status, sex,
<br /> gender, gender identity, gender expression, age, sexual orientation, or veteran or military status, in the
<br /> development and construction of the Property nor shall Developer itself or any person claiming under
<br /> or through him establish or permit any such practice or practices of discrimination or segregation with
<br /> reference to the development and construction of the Property. The foregoing covenants shall run with
<br /> the land and shall remain in effect until termination of the Agreement. Following the Certificate of
<br /> Completion for construction of the homes,the Developer's obligation to refrain from discrimination
<br /> shall be governed by the provisions of the Regulatory Agreement.
<br /> (a) In Employment. In construction on the Property, Developer shall not
<br /> discriminate against any employee or applicant because of race, religious creed, color, national
<br /> origin, ancestry, physical disability, mental disability, reproductive health decisionmaking,
<br /> medical condition, genetic information, marital status, sex, gender, gender identity, gender
<br /> expression, age, sexual orientation, or veteran or military status . Developer shall take affirmative
<br /> action to ensure that applicants are employed, and that employees are treated during employment,
<br /> without regard to their race,religious creed, color, national origin, ancestry, physical disability,
<br /> mental disability, reproductive health decisionmaking, medical condition, genetic information,
<br /> marital status, sex, gender, gender identity, gender expression, age, sexual orientation, or veteran
<br /> or military status.
<br /> (b) In all Contracts.Developer shall cause the foregoing covenants to be inserted
<br /> in all contracts for any work covered by this Agreement so that such provisions will be binding upon
<br /> each contractor for die benefit of City,provided that the foregoing covenant shall not apply to contracts
<br /> or subcontracts for standard commercial supplies or raw materials.

<br /> 7. GENERAL PROVISIONS AND WARRANTIES
<br /> As a material inducement to City to enter into this Agreement, Developer represents and
<br /> warrants as follows,which representations and warranties are made solely by Developer and not by
<br /> or on behalf of any partner of Developer:
<br /> 7.1 Formation, Qualification and Compliance. Developer is a nonprofit
<br /> organization. Developer is in compliance with all laws applicable to its business and has obtained
<br /> all approvals, licenses, exemptions and other authorizations from, and has accomplished all
