The nearest parking for the <br />Festival Hall, with the exception of a few on -street spaces, is ja <br />the City parking lot on the north side of Third Street across from <br />the Hall, and in the lot at Bush and Third behind the Old City 'Hall <br />bra i lding _ <br />3.0 APPLICABLE NOISE STANDARDS <br />The City's Noise Ordinance, contained in Appendix 1, is <br />designed to control noise emissions from one land use to <br />another land use. Generally, noise created on a public right-of- <br />way is not regulated by the Voise Ordinance, In theory, that would <br />mean that once patrons, cars, eta., connected with the Festival <br />Hall are off the Festival Hall property, the Festival Hall is not <br />liable for the noise conditions. However, the same might be said <br />of the issues regarding patron behavior, which, are clearly <br />addressed off -site by the private ,security guards employed by the <br />Festival Hall. Thus, there is some ,prospect that noise produced by <br />patrons will be treated as a responsibility of the Festival Hall. <br />Thus, from the Festival Hall perspective, they need to be cerCain <br />that the, same standards governing cn-site produced noise, which <br />Yields the proposed mitigations by the developer, also be, applied <br />to off -site noise for which. the Festival. Hall will be held <br />responsible. <br />The issue of the applicability does not apply to the <br />parking .lot behind the old City Hall since it is a private parcel <br />and controlled by the Festival Hall during the operating hours. <br />While the same issue faces the parcel owners at other times, this <br />report will, not address that issue. <br />The basic Noise Ordinance limits are given in Table I <br />On the following page, <br />4 <br />
